CITY OF CORAL GABLES, FLORIDA ORDINANCE NO. 2026-07 AN ORDINANCE OF THE CITY COMMISSION OF CORAL GABLES, FLORIDA, AMENDING CHAPTER 74, “TRAFFIC AND VEHICLES,” ARTICLE I “IN GENERAL,” SECTION 74-3 “RIDING OF BICYCLES UPON PEDESTRIAN SIDEWALKS GENERALLY” AND CHAPTER 74 “TRAFFIC AND VEHICLES,” ARTICLE IV “BICYCLES, SKATEBOARDS, SCOOTERS, SHARED MOBILITY DEVICES, AND OTHER SIMILAR DEVICES,” SECTION 74-239 “DEFINITIONS” TO AMEND THE CITY CODE TO ADD A DEFINITION OF ELECTRIC BICYCLES AND PROHIBIT THE RIDING OF ELECTRIC BICYCLES ON CITY SIDEWALKS; PROVIDING FOR SEVERABILITY, REPEALER, CODIFICATION, AND AN EFFECTIVE DATE WHEREAS, the use of electrical bicycles has become more widespread in Coral Gables and the surrounding areas in the last few years; and WHEREAS, the City of Coral Gables wishes to regulate the use of electrical bicycles within the City as authorized in

Section 316.

20655, Florida Statutes ; and WHEREAS, the City Commission wishes to incorporate the current definition of electric bicycles in Florida Statutes and prohibit the riding of electric bicycles on sidewalks under the jurisdiction of the City;

NOW, THEREFORE,

BE IT ORDAINED BY THE COMMISSION OF THE CITY OF CORAL GABLES, FLORIDA: SECTION 1. That the foregoing “WHEREAS” clauses are hereby ratified and confirmed as being true and correct and are hereby madea specific part of this Ordinance upon adoption hereof. SECTION 2. That the City Commission does hereby amend Chapter 74, “Traffic and Vehicles,” Article I “In General,” Section 74-3 “Riding of bicycles upon pedestrian sidewalks generally” and Chapter 74, “Traffic and Vehicles,” , Article IV “Bicycles, Skateboards, Scooters, Shared Mobility Devices, and other Similar Devices”, Section 74-239 “Definitions”, as indicated in the attached Exhibit A!: SECTION 3. All Ordinances or parts of Ordinances inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. ‘ Deletions are indicated by strikethrough. Insertions are indicated by underline. Page 1 of 2- Ordinance No. 2026-07 SECTION 4. _ If any section, part of section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. SECTION 5. It is the intention of the Commission of the City of Coral Gables, Florida, that the provisions of this Ordinance shall become and be made part of the City Code and that the 39) 466 sections ofthis “Ordinance” may be changed to “section”, “article”, or such other appropriate word or phrase in order to accomplish such intentions. SECTION 6. Ifthe City Code Table of Contents or other reference portion is affected by these provisions, then changes are approved as a part of this Ordinance. SECTION 7. (a) The riding of bicycles upon the pedestrian sidewalks on Miracle Mile and where posted shall be prohibited and unlawful with the exception of law enforcement officers in performance of their duties. (b) The riding of electric bicycles, as defined in Section 74-239, is prohibited on all the city’s public sidewalks. (c)_ Violation of this section shall be punishable pursuant to section 1-7. Sec. 74-239. Definitions. For purposes of this article the following definitions apply: Deploy means the initial daily staging of a shared mobility device by an operator on designated areas of city right-of-way. Electric bicycle meansa bicycle or tricycle equipped with fully operable pedals, a seat or saddle for the useof the rider, and an electric motor of less than 750 watts which meets the requirements of one of the classifications provided for in Florida Statutes

Section 316.

003 (23), as amended: (1) Class 1 Electric Bicycle means an electric bicycle equipped with a motor that provides assistance only when the rider is pedaling and that ceases to provided assistance when the electric bicycle reaches the speed of 20 miles per hour. (2) Class 2 Electric Bicycle means an electric bicycle equipped with a motor that many be used exclusively to propel the electric bicycle and that ceases to provide assistance when the electric bicycle reaches the speed of 20 miles per hour. (3) Class 3 Electric Bicycle means an electric bicycle equipped with a motor that provides assistance only when the rider is pedaling and that ceases to provide assistance when the electric bicycle reaches the speed of 28 miles per hour. Micromobility device means a motorized transportation device designed for individual use which is typically 20 to 36 inches in width and 50 pounds or less in weight and which operates at a speed of typically less that 15 miles per hour but no more than 28 miles per hour. 003(41), Florida Statutes, as amended, includes both a human-powered and nonhuman-powered device such as a bicycle, electric bicycle, motorized scooter, or any other device that is owned by an individual or part of a shared fleet. Motorized scooter means a vehicle as defined in F.S. § 316.003(4548). Operator means a company deploying shared mobility devices within the city. Rebalance means moving shared mobility devices from an area of low demand to an area of high demand, or to return to designated areas of deployment. Shared mobility device means an individual device including, but not limited to, motorized or electronic scooters, bicycles, and other similar devices, but does not include motor vehicles used in conjunction with ride sharing companies, such as Uber or Lyft. Shared mobility device program means a program generally, in which mobility devices, including, but not limited to, bicycles and motorized scooters, are made available for shared use to individuals on a short-term basis at no cost or for a fee.
