Page 1 of 3 – Ordinance No. 2026-15 CITY OF CORAL GABLES, FLORIDA ORDINANCE NO. 2026-15 AN ORDINANCE OF THE CITY COMMISSION OF CORAL GABLES, FLORIDA, AMENDING CHAPTER 2 “ADMINISTRATION”, ARTICLE I- “IN GENERAL” TO CREATE SECTION 2-6 “REGISTERED AGENT” IN ORDER TO CODIFY THE MAYOR’S DESIGNATION OF THE CITY ATTORNEY AS THE CITY’S REGISTERED AGENT FOR SERVICE OF PROCESS FOR PURPOSES OF CHAPTER 48, FLORIDA STATUTES; PROVIDING FOR SEVERABILITY, REPEALER, CODIFICATION, AND AN EFFECTIVE DATE WHEREAS, Section 6 of the City Charter provides that the Mayor shall be recognized as the official head of the City by the courts for the purpose of serving civil processes; and WHEREAS, Florida Statutes

Section 48.

111(a) states that process against any municipal corporation may be served on the registered agent of a municipality; and WHEREAS, in coordination with the Mayor’s office, the City’s Attorney’s office has traditionally accepted service of legal documents on behalf of the City, which was facilitated by the City Attorney’s location in City Hall with the City’s elected officials; and WHEREAS, as the City transitions to temporary quarters during the renovation and restoration of City Hall the Mayor believes it is in the best interest of the City to formally designate the City Attorney and the City Attorney’s office as the registered agent for purposes of service of process pursuant to Chapter 48, Florida Statutes, in order to best serve the public and the City in centralizing service on the City and to codify that designation for public awareness;

NOW, THEREFORE,

BE IT ORDAINED BY THE COMMISSION OF THE CITY OF CORAL GABLES, FLORIDA: SECTION 1. That the foregoing “WHEREAS” clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Ordinance upon adoption hereof. That the City Commission does hereby amend Chapter 2, “Administration,” Article I “In General,” to create Section 2-6 “Registered Agent” as indicated below1: Sec 2-6.- Registered Agent Consistent with Section 6 of the City Charter and applicable Florida Statutes, the Mayor has designated the City Attorney as the registered agent of the City. The City Attorney, and authorized persons in the City Attorney’s Office, are authorized to accept service of process for purposes of Chapter 48, Florida Statutes, on behalf of the City of Coral Gables, Florida, the City Commissioners of Coral Gables, Florida, and any member of the City Commission of Coral Gables, Florida who is sued in his or her official capacity unless that commissioner who is an individual defendant in a lawsuit in his or her official capacity, has in writing to the City Attorney revoked the authority to accept service of process on his or her behalf. SECTION 3. All Ordinances or parts of Ordinances inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. SECTION 4. If any section, part of section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. SECTION 5. It is the intention of the Commission of the City of Coral Gables, Florida, that the provisions of this Ordinance shall become and be made part of the City Code and that the sections of this “ordinance” may be changed to “section”, “article”, or such other appropriate word or phrase in order to accomplish such intentions. SECTION 6. If the City Code Table of Contents or other reference portion is affected by these provisions, then changes are approved as a part of this Ordinance. SECTION 7. This Ordinance shall become effective upon its passage and adoption herein. PASSED AND ADOPTED THIS NINETEENTH DAY OF MAY, A.D., 2026.
