No. 26-69 Page 1 of 3 RESOLUTION No. 26-69 A RESOLUTION OF THE MAYOR AND THE CITY COUNCIL OF THE CITY OF DORAL, FLORIDA, INSTRUCTING CITY STAFF AND THE CITY ATTORNEY TO CREATE A POLICY REQUIRING HOTELS TO POST “NO HOURLY RATE” SIGNS; TO CREATE PENALTIES WHICH MAY INCLUDE WITHHOLDING OF THEIR BUSINESS TAX RECEIPT; PROVIDING FOR IMPLEMENTATION; PROVIDING FOR INCORPORATION OF RECITALS; AND PROVIDING FOR AN EFFECTIVE DATE WHEREAS, the Mayor and City Council of the City of Doral (the “City”)seek to promote public safety, lawful business practices, and the general welfare of the community; and WHEREAS, the City recognizes that the operation of hotels offering hourly rates is prohibited under Florida Statute § 509.098; and WHEREAS, hourly hotel usage lends itself to illegal activity such as prostitution, sex and human trafficking and drug trafficking; and WHEREAS, the City through its code enforcement authority may establish and require hotels to post signage that provides notice to hotel owners, employees and patrons that hourly rates are prohibited; and WHEREAS, the Mayor and City Council find it appropriate to direct City staff and the City Attorney to develop a formal policy requiring hotels within the City of Doral to post visible signage indicating that hourly rates are not offered; and WHEREAS, the Mayor and City Council further desire that such policy include enforcement provisions and penalties for non-compliance, which may include, but are not limited to, the withholding, suspension, or revocation of a Business Tax Receipt; and Res. No. 26-69 Page 2 of 3 WHEREAS, the Mayor and City Council find that directing the preparation of such policy is in the best interest of the public health, safety, and welfare of the residents of the City of Doral.

NOW THEREFORE,

BE IT RESOLVED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF DORAL, FLORIDA, AS FOLLOWS: Section 1. Recitals. The above recitals are true and correct and incorporated herein. Section 2. Creation of Hourly Rate Notice Policy. The City Mayor and Council hereby authorize and instruct the City Manager and City Attorney to work on an Ordinance that establishes a requirement that all hotels located in the City of Doral shall provide for signage that notifies all hotel owners, employees and patrons that hourly rates are prohibited by law. This ordinance shall provide for penalties and fines. Section 3. Implementation. The City Manager and City Attorney are authorized to take any additional actions necessary to implement this Resolution, including making any modifications, executing any documents and addendums as necessary to effectuate this Resolution, provided that such actions remain consistent with the Council’s intent. Section 4. Severability. If any clause, sentence, or phrase of this Resolution is for any reason held invalid or unconstitutional by a court of competent jurisdiction, this holding shall not affect the validity of the remaining portions of this Resolution. Section 5. Effective Date. This Resolution shall become effective immediately upon adoption by the City Council and is binding on all successors and assigns.
