Second reading and public hearing of proposed ordinance granting a Variance Permit to allow a lot coverage of 37.8%, where 30% is the maximum lot coverage allowed; and to allow an interior west side setback of 9.45 feet, where 10 feet are required for an existing addition to be legalized; all in contrast to Hialeah Code of Ordinances §98-2056(b)(2), and §98-590. Property located at 40 West 15 Street, Hialeah, zoned R-3 (Multiple-Family District) and legally described herein; repealing all ordinances or parts of ordinances in conflict herewith; providing penalties for violation hereof; providing for a severability clause; and providing for an effective date. On December 9, 2025, the City Council approved the item on first reading. Second reading and public hearing is scheduled for January 13, 2026. On November 19, 2025, the Planning and Zoning Board recommended the approval of this item subject to conditions. Conditions: The applicant must update the plans to include a dumpster enclosure before a building permit is issued, or apply for a separate building permit to construct the required enclosure.
