Second reading and public hearing of proposed ordinance rezoning property from C-2 Liberal Retail Commercial District to R-3-3 Multiple Family District; granting a variance to allow a street-side setback of 10 feet, where 15 feet is required, contra to Hialeah Code of Ordinances § 98-590 of the City’s Land Development Code for the property located at 2295 West 4th Court, Hialeah, zoned C-2, legally described herein; repealing all ordinances or parts of ordinances in conflict herewith; providing penalties for violation hereof; providing for a severability clause; and providing for an effective date. On May 26, 2026, the City Council approved the item on first reading. Second reading and public hearing is scheduled for June 9, 2026, at 5:30 p.m. On May 13, 2026, the Planning and Zoning Board recommended approval subject to conditions. Conditions: 1. The site shall be developed in substantial accordance with the plans signed and sealed by Dulce M. Conde, AR, dated 3/10/2026; and 2. The applicant shall obtain all required approvals from the City of Hialeah Water and Sewer Division and Miami-Dade County Department of Environmental Resources Management (DERM), including compliance with any conditions related to the existing sanitary sewer pump station conditional moratorium; and 3. The applicant shall obtain approval from the Streets Division for the modification of the existing sidewalk within the public right-of-way to accommodate driveway access, in accordance with City standards; and 4. All required building permits, site plan approvals, and concurrency reviews shall be obtained prior to commencement of construction. Planner's recommendation: Approval with conditions.
