First reading of proposed ordinance granting a Special Use Permit (SUP) pursuant to the City of Hialeah Code of Ordinances § 98-161 to allow a Biomedical Research Center for the property located at 6815 West 4th Avenue, Hialeah, zoned C-2 Liberal Retail Commercial District , legally described herein; providing for conditions of approval; accepting the Declaration of Restrictions; repealing all ordinances or parts of ordinances in conflict herewith; providing penalties for violation hereof; providing for a severability clause; and providing for an effective date. On June 10, 2026, the Planning and Zoning Board recommended approval of the item subject to conditions. Conditions: 1. The applicant shall enter into a Declaration of Restrictions (DOR) stipulating that the Special Use Permit to the Biomedical Research Center shall be limited to pharmaceutical and medical device clinical trials under FDA-approved protocols and its operation shall be only in conjunction with the existing medical office located and limited to commercial units identified as 6867 through 6871 within the property and shall not be established as a stand- alone use. 2. The Special Use Permit shall be limited to outpatient activities with no invasive medical procedures and no ambulance services, except in an emergency, as described in the Letter of Intent received on April 29, 2026, with no overnight stays or inpatient services permitted. The collection of samples for off-site testing is permissible. 3. The hours of operation shall be limited to Monday, Wednesday, Thursday, and Friday from 9:00 a.m. to 5:00 p.m., and Saturday from 9:00 a.m. to 12:00 p.m. The facility shall remain closed on Tuesday and Sunday. 4. The applicant shall maintain all required Business Tax Receipts and permits necessary for the operation of the Biomedical Research Center. 5. Any expansion or intensification of the uses beyond that represented in the Application and Letter of Intent shall require further review and approval
