First reading of proposed ordinance granting variances to allow: (i) north side setback of 0 feet, where 5 feet, 1 inch is required, and (ii) 0 feet landscape buffer facing East 47th Street, where a minimum 7 feet landscape buffer is required; contra to Hialeah Code of Ordinances § 98-1372, § 98-1706, and the Hialeah Landscape Manual, updated July 2025, Section "D" for the property located at 4698 East 10th Lane, Hialeah, zoned M-1 (I ndustrial District) ; repealing all ordinances or parts of ordinances in conflict herewith; providing penalties for violation hereof; providing for a severability clause; and providing for an effective date. On March 11, 2026, the Planning and Zoning Board recommended the approval of the item subject to conditions. Conditions: 1. The applicant shall proffer a Declaration of Restrictions delineating a maximum of six (6) months from the date of this application approval to submit the required site plan and concurrency approvals from the City of Hialeah. If no site plan and concurrency application are received, this application approval will be rescinded and revoked. 2. The project shall be developed in accordance with the signed and sealed plans prepared by Ramon F. Camayd, P.A., dated February 13th, 2026, according to the following modifications: a. The dumpster enclosure shall maintain a minimum 2 feet setback from the south property line, and the site plan shall be revised to clearly indicate the required setback dimension; and b. The site plan shall be revised to provide a minimum of 7 feet landscape buffer along the east property line, in compliance with the City of Hialeah Code of Ordinances; and c. The swale area along East 10th Lane shall not be used for parking unless approval is obtained from the City of Hialeah's Streets Department. Planner's recommendation: Approval with conditions.
