Second reading and public hearing of proposed ordinance granting variances to allow: (i) the required off-street parking spaces to be located partially within the right-of-way, where off-street parking must be located within the property lines; (ii) 11 parking spaces, where 16 parking spaces are required; (iii) all parking spaces to back out into the right-of-way, where back-out parking is not permitted, and (iv) 0% pervious area, where 10% is the minimum pervious area required, contra to Hialeah Code of Ordinances § 98-2191, § 98-2189, § 98-2190, and the Hialeah Landscape Manual, updated July 2025, Section “E,” respectively; and granting a waiver of the minimum landscape requirements through landscape mitigation pursuant to § 98-2235 for the property located at 4725 East 10th Court and 4735 East 10th Court, Hialeah, zoned M-1 (I ndustrial District) ; repealing all ordinances or parts of ordinances in conflict herewith; providing penalties for violation hereof; providing for a severability clause; and providing for an effective date. On April 28, 2026, the City Council approved the item on first reading. Second reading and public hearing is scheduled for May 12, 2026, at 5:30 p.m. On April 15, 2026, the Planning and Zoning Board recommended approval of this item subject to conditions. Conditions: 1. The applicant shall enter into a Declaration of Restrictions to define the parking and operational plan provided by the business owner of NextGen Motors Miami; and 2. No additional uses will be permitted on the property; and 3. The applicant agrees that random inspections regarding parking will be conducted to maintain compliance within the property.
