Second reading and public hearing of proposed ordinance granting a Conditional Use Permit (CUP) pursuant to the City of Hialeah Code of Ordinances §98-181(2)(i) to allow a K-5th grade private elementary school with a maximum capacity of 80 students in conjunction with a 143-children daycare center; granting a Variance Permit to allow 19 parking spaces, where 30 parking spaces are required; and to allow a waiver of minimum landscape requirements through landscape mitigation as per Section 98-2235; all in contrast to the City of Hialeah Code of Ordinances §98-2189(8). Property is located at 2400 West 56 Street, Hialeah, zoned R-3-5 (Multiple Family District) and legally described herein; repealing all ordinances or parts of ordinances in conflict herewith; providing penalties for violation hereof; providing for a severability clause; and providing for an effective date. On December 9, 2025, the City Council approved the item on first reading. Second reading and public hearing is scheduled for January 13, 2026. On November 19, 2025, the Planning and Zoning Board recommended the approval subject to conditions: Conditions: The applicant proffers a Declaration of Restriction for the K-5th private elementary school with a maximum capacity of 50 students, in conjunction with a 143-child daycare. The applicant shall obtain Change of Use permit within the next 12 months. The applicant must provide a landscaping mitigation plan at building permitting, if needed. The applicant provides a Parking Analysis and Parking Mitigation Plan prior to the second reading of the ordinance at City Council. Planners recommendation: Approval with conditions.
