Second reading and public hearing of proposed ordinance Granting a Special Use Permit (SUP) to allow the expansion of the Neighborhood Business District (NBD) Overlay in relation to a proposed mixed-use development, including 71 residential units, pursuant to Hialeah Code of Ordinances §98-161; granting a Variance Permit to allow 59 multifamily units (83%) with an area less than 700 square feet, where 700 square feet is the minimum required, and only 25% of residential units may have an area of 500 square feet; allow a front setback of 5.66 feet, where 10 feet built-to-line are required for the balconies fronting East 4 Avenue; allow side setbacks of 1 foot, where 10 feet built-to-line are required for all balconies facing East 2 Street and East 3 Street; allow 19.16% pervious area, where 30% pervious area is the minimum required, and allow partial waiver of minimum landscape requirements through landscape mitigation as per Section 98-2235; all in contrast to Hialeah Code of Ordinances §98-1630.2., §98-1630.3(e)(l), and in contrast to the Hialeah Landscape Manual, dated December 13, 2022, Section "E", entitled "Tree and Lawn Requirements by Zoning Classification". Properties located at 250 East 4 Avenue and Folio No. 04-3118-006-1820, Hialeah, zoned CR (Commercial Residential District) and legally described in Exhibit "A"; repealing all ordinances or parts of ordinances in conflict herewith; providing penalties for violation hereof; providing for a severability clause; and providing for an effective date. On January 13, 2026, the City Council approved the item on first reading. Second reading and public hearing is scheduled for January 27, 2026. On December 10, 2025, the Planning and Zoning Board recommended the approval of this item subject to conditions. Conditions: 1.
