Second reading and public hearing of proposed ordinance rezoning property from R-1 (One- Family District) to TOD (Transit Oriented Development District); granting a Variance Permit to allow a single- use multifamily residential building with 33 units, where a vertical mix of uses is required; to allow a front setback of 15.7 feet, where 20 feet are required; to allow 7.5% pervious area, where 10% is the minimum pervious area required; to allow partial waiver of minimum landscape requirements through landscape mitigation as per Section 98-2235, and to allow the mitigation of 1 parking space as per Section 98-1546(b)(1); all in contrast to Hialeah Code of Ordinances §98-1538(b), §98-1544(b)(3)ii, and Section "E" of the Hialeah Landscape Manual, updated July 2025, entitled "Tree and Lawn Requirements by Zoning Classification. Properties located at 1002 East 19 Street and 1012 East 19 Street, Hialeah, zoned R-1 (One-Family District) and legally described herein; repealing all ordinances or parts of ordinances in conflict herewith; providing penalties for violation hereof; providing for a severability clause; and providing for an effective date. On January 13, 2026, the City Council approved the item on first reading. Second reading and public hearing is scheduled for January 27, 2026. On December 10, 2025, the Planning and Zoning Board recommended the approval subject to conditions. Conditions: 1. The applicant enters into a Declaration of Restriction to develop the site according to plans signed and sealed by Manny Reus (Architect), dated September 8, 2025. 2. The applicant submits a one-time landscape mitigation payment, the amount of which will be calculated during the Site Plan and Concurrency review process. 3. The applicant submits a one-time parking mitigation payment of $25,420.00 at the time of the Site Plan and concurrency process. 4. The applicant provides a Unity of Title and records it with the Miami-Dade County Clerk of the Court prior to final approval of
