Second reading and public hearing of proposed ordinance granting a Variance Permit to allow 3 on-site parking spaces and 2 on-street parking spaces, where 11 parking spaces are required; allow 7.7% pervious area, where 10% is the minimum pervious area required, and to allow the mitigation of one tree as provided by §98.2235; all in contrast to Hialeah Code of Ordinances §98-2189(7), and Section "E" of the Hialeah Landscape Manual, updated July 2025, entitled "Tree and Lawn Requirements by Zoning Classification". Property located at 223 West 27 Street, Hialeah, zoned M-1 (I ndustrial District) and legally described herein; repealing all ordinances or parts of ordinances in conflict herewith; providing penalties for violation hereof; providing for a severability clause; and providing for an effective date. On December 9, 2025, the City Council approved the item on first reading. Second reading and public hearing is scheduled for January 13, 2026. On November 18, 2025, the City Council postponed the item on first reading. First reading is scheduled for December 9, 2025. On October 29, 2025, the Planning and Zoning Board recommended the approval of this item subject to conditions. Conditions: The applicant shall enter into a Declaration of Restriction to restrict the operation of the dance studio to only 223 W 27 St and provide for a shared parking agreement with the business located at 221 W 27 St; and The applicant shall provide a tree on-site according to the approved 1985 site plan or provide mitigation fees for one tree.
