Second reading and public hearing of proposed ordinance rezoning properties located at 1780 East 4 Avenue and 375 East 17 Street from R-2 (One-and Two-Family Residential District) to B-1 (Highly Restricted Retail District); granting a Conditional Use Permit (CUP) pursuant to the City of Hialeah Code of Ordinances §98-181(2)(i) to allow a K-12 grade private school with a maximum capacity of 272 students in conjunction with a 14-children daycare; granting a Variance Permit to allow 51 parking spaces, where 57 parking spaces are required, and allow the existing dumpster enclosure to be 1 foot from the right-of-way facing East 18 Street, where 10 feet is the minimum required; all in contrast to Hialeah Code of Ordinances §98- 2189(8) and (9), and §78-108(c)(l). Properties located at 375 East 17 Street, 1702 East 4 Avenue, 1780 East 4 Avenue, and 1750 East 4 Avenue, Hialeah, zoned R-2 (One-and Two-Family Residential District) and legally described herein; repealing all ordinances or parts of ordinances in conflict herewith; providing penalties for violation hereof; providing for a severability clause; and providing for an effective date. On December 9, 2025, the City Council approved the item on first reading. Second reading and public hearing is scheduled for January 13, 2026. On November 19, 2025, the Planning and Zoning Board recommended the approval of this item subject to conditions. Conditions: The applicant shall enter into a Declaration of Restriction for the K-12th grade Conditional Use Permit (CUP) with a maximum student capacity of 265 students and a daycare with a maximum capacity of 21 children. The applicant shall enter into a Unity of Title for the four parcels of land included in this application. The applicant shall obtain a Change of Use permit within 12 months. The applicant addresses any traffic and parking conditions if negative impacts are found in the surrounding areas of the unified properties. Planner's recommendation: Approval with conditions.
