Second reading and public hearing of proposed ordinance rezoning property from R-1 (One-Family Residential District) to R-2 (One- and Two- Family District); granting variances to allow: (i) a total lot area of approximately 6,750 square feet, where 7,500 square feet is required, (ii) a front setback of 24.75 feet, where 25 feet is required, (iii) a west side setback of 7.08 feet for the principal building and 3.08 feet for the existing detached dwelling unit, where 7.5 feet is required, (iv) the existing detached dwelling unit to be legalized with a floor area of approximately 848 square feet, where 1,000 square feet is the minimum required, (v) a rear setback of 5.91 feet, where 25 feet is required, and (vi) an east side setback of 4.50 feet, where 7.5 feet is required, all contra to Hialeh Code of Ordinances § 98- 544, § 98-545, 98-546, § 98-548, and § 98-547, of the City’s Land Development Code for the property located at 574 East 21 Street Hialeah, zoned R-1, legally described herein; repealing all ordinances or parts of ordinances in conflict herewith; providing penalties for violation hereof; providing for a severability clause; and providing for an effective date. On May 26, 2026, the City Council approved the item on first reading. Second reading and public hearing is scheduled for June 9, 2026, at 5:30 p.m. On May 13, 2026, the Planning and Zoning Board recommended approval subject to conditions. Conditions: 1. Enter into a Declaration of Restrictions to restrict the development and approval of the site according to the plans submitted for this rezoning and variance application, inclusive of the landscaping improvements that have been prepared by Manuel E. Siques, P.E. signed and sealed on April 7, 2026; and 2. The applicant shall obtain a site plan and concurrency approval within six months of the rezoning and variance application.
