Approve settlement with Miami Beach Marina Associates

A resolution of the mayor and city commission of the city of miami beach, florida, approving the settlement agreement (settlement agreement) between the city of miami beach (city) and miami beach marina associates, ltd. (marina associates), in substantial form, and authorizing the city manager to finalize the settlement agreement in a form acceptable to the city attorney; authorizing the city manager and city clerk to execute the settlement agreement; and further approving amendment no. 5 to the marina lease agreement dated june 24, 1983 between the city and marina associates (fifth amendment to marina lease) and amendment no. 3 to the parking facility management and operation agreement dated december 1, 1999 by and among the city, the miami beach redevelopment agency and marina associates (third amendment to parking agreement) consistent with the terms of the settlement agreement, in substantial form; and further authorizing the city manager to finalize the fifth amendment to marina lease and third amendment to parking agreement; and further authorizing the mayor and city clerk to execute the fifth amendment to marina lease and the third amendment to parking agreement in a form acceptable to the city attorney.
