Background of Item: Pursuant to Resolution No. R-22-0392, adopted on October 13, 2022, the Miami Commission approved the transfer of CDBG-CV3 funds in the amount of $2,075,000.00 to the City’s Department of Parks and Recreations, which included an amount of $450,897.50 to the Department of Housing and Community Development for future allocation in District 1. The expenditure deadline for CDBG-CV3 funds is June 17, 2026, and there is still an additional unexpended portion of this funds in the amount of $135,231.38 that must be reallocated to the Department of Parks and Recreation (“Parks Department”) to be used for CDBG-CV3 eligible park improvement activities. The City’s Administration recommends the transfer of CDBG-CV3 funds in the amount of $450,897.50 from the Department of Housing and Community Development and additional unexpended portion of CDBG CV-3 in the amount of $135,231.38 for a total amount of $586,128.88 to “Park Department” from FY 2020-2021 for park improvement to Charlie DeLucca Park, in District 1, as described in Exhibit “A,” attached and incorporated. NOW, THEREFORE,

BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The transfer of CDBG-CV3 funds from FY 2020-2021 in the total amount of $586,128.88 from HCD to the Parks Department for eligible park improvements to Charlie DeLucca Park, in District 1, is approved1. Section 3. The City Manager is authorized¹ to negotiate and execute any and all necessary documents, all in a form acceptable to the City Attorney, for said purpose. 1 The herein authorization is further subject to compliance with all legal requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and City Code provisions. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
