WHEREAS, on February 9, 1989, via Ordinance 10544, the City Commission adopted the Miami Comprehensive Neighborhood Plan, which has been amended from time to time (“MCNP”); and WHEREAS, the MCNP is intended to guide the future development and distribution of land uses within the City of Miami (“City”) in a manner that is consistent with the goals, objectives, and policies of the MCNP; and WHEREAS, Policy PA-3.1.1 of the MCNP provides that the City shall maintain a Working Waterfront Table of Properties (“the Table”) to guide future development within the Miami River Corridor; and WHEREAS, the Table shall clearly depict the location and description of all properties of recreational and commercial working waterfront uses on the River, as defined in
07, Florida Statutes (hereinafter referenced as the "Working Waterfront"); and WHEREAS, the Table shall classify working waterfront properties into Categories "A" and "B" and shall be incorporated as supporting data and analysis within Appendix PA-1; and WHEREAS, Policy PA-3.1.4 of the MCNP provides that the City shall encourage the establishment and maintenance of Working Waterfront uses along the banks of the Miami River, and to discourage encroachment by incompatible uses; and WHEREAS, on October 22, 2009, the City Commission adopted Ordinance No. 13114, the Zoning Ordinance of the City of Miami, Florida, which has been amended from time to time ("Miami 21 Code"); and WHEREAS, Miami 21 Code shall establish permitted uses in the zoning transects consistent with the goals, objectives and policies of the MCNP, including the Working Waterfront properties included in Appendix PA-1 of the MCNP; and WHEREAS, it has been determined that amending the Miami 21 Code, specifically Article 6, titled "Supplemental Regulations," to clarify regulations related to fishing equipment City of Miami File ID: 18107 (Revision: ) Printed On: 11/11/2025 and/or fishing supplies storage uses will improve the effectiveness of the Miami 21 Code requirements for these establishments; and WHEREAS, the City is desirous of allowing fishing equipment and/or supplies storage use, by right, on the Working Waterfront properties included in Appendix PA-1 of the MCNP; and WHEREAS, allowing fishing equipment storage on the Working Waterfront properties included in Appendix PA-1 of the MCNP will promote the goals and policies of the MCNP; and WHEREAS, the City’s Planning Department recommends approval of this Miami 21 Code text amendment; and WHERAS, on September 3, 2025, at a duly noticed public meeting, the Planning, Zoning and Appeals Board (“PZAB”) considered PZAB Item. 9 and passed Resolution No. PZAB R-25- 051, by a vote of seven to zero (7-0), recommending approval of the proposed Miami 21 Code text amendment; and WHEREAS, consideration has been given as to whether the proposed change will further the goals, objectives, and policies of the MCNP, the Miami 21 Code, and other City regulations; and WHEREAS, due consideration has been given to the need and justification for the proposed change, including changing and changed conditions that make the passage of the proposed change necessary;
NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Article 6 of the Miami 21 Code is hereby amended in the following particulars:1 “ARTICLE 6. If any section, part of a section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 4. It is intended that the provisions of the Ordinance become and be made a part of the Miami 21 Code, which provisions may be renumbered or relettered and that the word “ordinance” may be changed to “section”, “article”, or other appropriate word to accomplish such intention. Section 5. This Ordinance shall become effective ten (10) days after adoption. 2 APPROVED AS TO FORM AND CORRECTNESS: 2 This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten (10) days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is later.
