Background of Item: The Florida Department of Transportation (“FDOT”) has developed design plans Financial Management (“FM”) Project No. FM 447214-1-52-01 for the milling and resurfacing of the existing asphalt pavement, installation of new FPL service point and pull boxes, removal of existing FPL service point and pull boxes, and installation of sidewalks within the project area (“Project”). FDOT intends to undertake and complete the Project, a portion of which includes work on roads not on the State Highway System but City of Miami (“City”) right-of-way, specifically along the south side of NE 18 Street from SR 5 to 184 feet west of SR 5, along NE 54 Street between SR 5 and Federal Highway, along Federal Highway NB outside lane from NE 54 Street to 58 feet south of NE 54 Street, along the south side of NE 72 Terrace from SR 5 to 135 feet east of SR 5, along the north side of NE 73 Street from SR 5 to 70 feet east of SR 5, along the north side of NE 74 Street from SR 5 to 105 feet east of SR 5, along the south side of NE 83 Street from SR 5 to 136 feet west of SR 5, and along the north side of NE 85 Street from SR 5 to 72 feet east of SR 5 (for purposes of this agreement, the “Off-System Project Limits”). The Off-System Construction and Maintenance Agreement (“Agreement”), attached and incorporated as Exhibit “A”, establishes the terms, conditions, and responsibilities of FDOT and the City to accomplish the Project and Local Roadway Improvements on the City’s Streets. The City agrees with the terms and conditions in the Agreement, in substantially the attached form. NOW, THEREFORE,

BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized1 to execute the Agreement, in substantially the attached form, with FDOT, for the Project on State Road 5/United States Highway 1 (US- 1)/Biscayne Boulevard at various locations to include roads not on the state highway system, which are Northeast 18 Street, Northeast 54 Street, Northeast 72 Terrace, Northeast 73 Street, Northeast 74 Street, Northeast 83 Street, and Northeast 85 Street, Miami, Florida, and for the Local Roadway Improvements. Section 3. This Resolution shall become effective immediately upon its adoption. APPROVED AS TO FORM AND CORRECTNESS: 1 The herein authorization is further subject to compliance with all legal requirements that may be imposed, including but not limited to, those prescribed by applicable City Charter and City Code provisions.
