Background of Item: The Virginia Key Advisory Board (VKAB) convenes monthly to evaluate and discuss matters related to the governance of Virginia Key. As part of its responsibilities, the board reviews all relevant information to determine the most effective governance model for the area. The Virginia Key Advisory Board is proposing a resolution to amend the City Code (Chapter 2, Article XI, Division 13.5, Section 2-1193) to reduce the quorum requirements for the Virginia Key Advisory Board. The proposed ordinance includes a severability clause (to keep the rest of the ordinance valid if part is struck down) and would become effective immediately upon approval. WHEREAS, the Virginia Key Advisory Board (“VKAB”) was created and established pursuant to City of Miami (“City”) Ordinance No. 13583, adopted January 14, 2016, and codified in Chapter 2, Article XI of the Code of the City of Miami, Florida, as amended ("City Code"); and WHEREAS, Section 2-1192 of the City Code sets forth the purpose, powers, and duties of the VKAB, including to “serve in an advisory capacity to the city commission and recommend any changes to city laws, rules, regulations, practices, policies, or to help the city better promote the restoration, reopening, and success of Marine Stadium and Virginia Key;” and WHEREAS, the VKAB has had difficulty establishing quorum; and WHEREAS, the proposed reduction of the quorum requirement to five (5) voting members of the VKAB for the purpose of convening any meeting or conducting any business to enhance the VKAB's ability to offer timely recommendations and input to the City in line with its powers;

NOW, THEREFORE,

BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Commission hereby authorizes1 the City Manager to place an item on a future agenda codifying the proposed ordinance amending Chapter 2, Article XI, Division 13.5, Section 2-1193 of the City Code, attached and incorporated as Exhibit “A,” to reduce the quorum requirements of the VKAB, as stated therein. Section 3. This Resolution shall become effective immediately upon its adoption. 1 The herein authorization is further subject to compliance with all legal requirements that may be imposed, including but not limited to, those prescribed by applicable City Charter and City Code provisions.
