AGENDA ITEM SUMMARY FORM File ID: #17180 Date: 01/27/2025 Requesting Department: Department of Fire- Rescue Commission Meeting Date: 02/27/2025 Sponsored By: District Impacted: All Type: Resolution Subject: Sole Source - Purchase of Two (2) WingtraOne Drones Purpose of Item: The purpose of this item is to respectfully request a Resolution of the Miami City Commission, by a four-fifths (4/5ths) affirmative vote, pursuant to Section 18-92(a) of the Code of the City of Miami, Florida, as amended ("City Code"), after an advertised Public Hearing, ratifying, authorizing, and confirming the City Manager's finding of a Sole Source; waiving the requirements for competitive sealed bidding procedures and approving the purchase of two (2) WingtraOne Package Empty Gen II Fixed Wing Drones (“WingtraOne Drones”), from Lengemann Corporation (“Lengemann”), to be allocated from the various sources of funds of the Fire-Rescue Department (“Fire-Rescue”); subject to the availability of funds and budgetary approval at time of need; authorizing the City Manager to negotiate and execute all other documents, including any agreements, amendments, renewals, and extensions, subject to allocations, appropriations and budgetary approval having been previously made, and in compliance with applicable provisions of the City Code, including, the City of Miami's Procurement Ordinance, Anti- Deficiency Act, and Financial Integrity Principles, all as set forth in Chapter 18 of the City Code, in a form acceptable to the City Attorney, and in compliance with applicable regulations, as may be necessary for said purpose. Background of Item: Fire-Rescue needs to purchase two (2) WingtraOne Drones, manufactured by Wingtra Corp., to enhance efficiency, safety and decision-making during rescue operations. Drones are becoming critical tools used by Fire-Rescue to locate hot spots, assist in search and rescue operations, data collection, damage inspection and the mapping and modeling of rescue operation sites. The purchase and use of drones is heavily regulated. As such, the City must purchase drones manufactured by companies approved by the United States Department of Defense (“DOD”) and the state of Florida. Wingtra Corp. is on the approved list of drone manufacturers for both entities. Wingtra Corp. is the sole source manufacturer of the WingtraOne Drones and Lengemann is Wingtra Corp.’s sole distributor for the State of Florida. The State of Florida had a “buy back” program for non-approved manufactures through which Fire-Rescue sold fifteen (15) drones. WHEREAS, the City's Fire-Rescue Department (“Fire-Recue”) has a need to purchase two (2) drones for various purposes to enhance efficiency, safety, and decision-making, and WHEREAS, drones are increasingly being used in the Fire Service for various purposes to enhance efficiency, safety, and decision-making including locating hot spots, search and rescue, mapping and modeling, and inspecting damage and collecting data; and WHEREAS, Fire-Rescue must purchase drones that meet current state and federal legal requirements; and WHEREAS, Wingtra Corp. is on the approved list of Drone Manufacturers by both the United States Department of Defense and the State of Florida and Lengemann is the sole distributer for Wingtra Corp. in the State of Florida; and WHEREAS, the City of Miami (“City”) uses Environmental Systems Research Institute (ESRI) software, a system already currently used by the City, for mapping and spatial analysis, and since ESRI is a gold partner with Wingtra Corp., data collected by Wingtra Corp., whose drones can carry thermal and video cameras and are designed for surveying and mapping, is uniquely compatible with the City’s ESRI software, making these drones of great assistance to Fire during rescue operations; and WHEREAS, pursuant to Section 18-92(a)(2) & (3) of the Code of the City of Miami, as amended ( "City Code"), the City Manager is waiving the requirements for competitive sealed bidding methods as not being practicable or advantageous;

NOW, THEREFORE,

BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. By a four-fifths (4/5ths) affirmative vote, pursuant to Section 18-92 of the City Code, after an advertised public hearing, the City Manager's findings of a sole source, is ratified, approved, and confirmed, the requirements for competitive sealed bidding methods are waived, and the request to purchase the WingtraOne Drones from Lengemann is approved. Section 3. Funds to be allocated from the various sources of funds of Fire-Rescue, subject to the availability of funds and budgetary approval at the time of need, are authorized1. Section 4. The City Manager is authorized1 to negotiate and execute all other documents, including any agreements, amendments, renewals, and extensions, subject to allocations, appropriations and budgetary approval having been previously made, and in compliance with applicable provisions of the Code of the City of Miami, Florida, as amended, ("City Code"), including, the City's Procurement Ordinance, Anti-deficiency Act, and Financial Integrity Principles, all as set forth in Chapter 18 of the City Code, in a form acceptable to the City Attorney, and in compliance with applicable regulations, as may be necessary for said purpose. Section 5. This Resolution shall become effective immediately upon its adoption. APPROVED AS TO FORM AND CORRECTNESS: 1 The authorization herein is further subject to compliance with all legal requirements that may be imposed, including but not limited to those prescribed by applicable City Charter and City Code provisions.
