WHEREAS, on October 22, 2009, the City Commission adopted Ordinance No. 13114, the Zoning Ordinance of the City of Miami, Florida, which has been amended from time to time (“Miami 21 Code”); and WHEREAS, on September 24, 2015, Ordinance No. 13561, amended the Miami 21 Code to include Appendix J: Wynwood Neighborhood Revitalization District (“Wynwood NRD- 1”), which has been amended under Ordinance Nos.13642, 13805, 13960, 14134, and 14243 to support the continued evolution of the Wynwood neighborhood; and WHEREAS, the Miami 21 Code has been amended under Ordinance Nos. 14250, 14236, 14235, and 14234, and 14302 to amend both By-Right and Waiver processes to simplify the review, permitting, and public hearing procedures leading to increased consistency and predictability; and City of Miami File ID: 17383 (Revision: ) Printed On: 6/30/2025 WHEREAS, this Ordinance amends the Miami 21 Code, Appendix J: Wynwood Norte NRD-1 to update the development standards for consistency with city-wide Miami 21 Code regulations; and WHEREAS, an amendment is necessary to allow properties within the Wynwood NRD-1 having a T5-L Transect Zone designation to be built to five (5) stories By-Right and eight (8) stories including Bonuses; and WHEREAS, a clarification to the Wynwood NRD-1 art requirements on new Buildings and facade alterations is required to update and clarify the minimum requirements for art on Building Façades to assist the neighborhood to retain and support this critical characteristic while allowing for design flexibility; and WHEREAS, an amendment is necessary to clarify the Wynwood NRD-1 parking calculation methodology without significantly altering the existing requirements; and WHEREAS, this amendment is also necessary to clarify the landscape and screening requirements associated with off-street parking, particularly addressing any newly constructed wall or fence fronting the public Right-of-Way when certain design criteria is met and the requirement of a Wynwood Design Review Committee (“WDRC”) recommendation to the Planning Director; and WHEREAS, to support the continued evolution of the Wynwood Neighborhood, the amendments provide additional NRD-1 Setback requirements for Wynwood NRD-1 Corridors and Wynwood Throughfares; and WHEREAS, the Wynwood Business Improvement District (“BID”) recommended that the Miami 21 Code be amended for such purposes as stated herein in relation to the Wynwood NRD-1; and WHEREAS, on April 2, 2025, at a duly noticed public meeting, the Planning, Zoning and Appeals Board (“PZAB”) considered the application for Zoning Text, item PZAB.1, and passed PZAB-R-25-013, recommending approval, by a vote of eight to zero (8-0); and WHEREAS, consideration has been given to the relationship of this proposed amendment to the goals, objectives and policies of the Miami Comprehensive Neighborhood Plan (“MCNP”), with appropriate consideration as to whether the proposed change will further the goals, objectives and policies of the MCNP; the Miami 21 Code; and other City regulations; and WHEREAS, consideration has been given to the need and justification for the proposed change, including changed or changing conditions that make the passage of the proposed change necessary; and WHEREAS, after careful consideration of this matter, it is advisable and in the best interest of the general welfare of the City and its inhabitants to amend the Miami 21 Code as hereinafter set forth;

NOW, THEREFORE,

BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted and incorporated as if fully set forth in this Section. Section 2. Appendix J: Wynwood Neighborhood Revitalization District (NRD-1), Section City of Miami File ID: 17383 (Revision: ) Printed On: 6/30/2025 3 – General to Zones, of the Miami 21 Code is hereby amended in the following particulars:1 “MIAMI 21 CODE * * * Appendix J – Wynwood NRD-1 * * * SECTION 3 – GENERAL TO ZONES * * * 3.4. WYNWOOD PUBLIC BENEFITS PROGRAM * * * c. Bonus Building Height shall be permitted if the proposed Development contributes toward the specified public benefits, above that which is otherwise required by the NRD-1, in the amount and in the manner set forth herein. 1. T5-L: five (5) Story maximum, bonus to eight (8) Stories; the first additional floor of Development Height shall only be permitted through Public Benefits for Affordable/Workforce Housing, Public Parks and Open Space, Civic Space Type, Civil Support Use, Cross-Block Connectivity, and/or cash contributions to the Wynwood Public Benefits Trust Fund. Additional bonus Height may be achieved through Public Benefits or through the Wynwood TDR Program. 1. 2. It is the intention that the provisions of this Ordinance shall become and be made a part of the Zoning Ordinance of the City of Miami, Florida, which provisions may be renumbered or relettered and that the word "ordinance" may be changed to "section", "article", or other appropriate word to accomplish such intention. Section 8. If any section, part of a section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 9. This Ordinance shall become effective ten (10) days upon adoption.2 APPROVED AS TO FORM AND CORRECTNESS: 2 This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten (10) days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is later.
