WHEREAS, the neighborhood commonly referred to as “Allapattah” in the City of Miami (“City”) spans approximately five (5) miles (“Allapattah”) and has long been home to a melting pot of residents from Central America to the Caribbean; and WHEREAS, Allapattah has an eclectic and rich history known for its culture, arts, festivals, shoppes, and marketplaces; and WHEREAS, Allapattah, however, has been plagued in recent years by crime, drugs, homelessness, decay, slum, blight, and lack of affordable housing, which has resulted in the displacement of many longtime residents and businesses; and WHEREAS, the City wishes to identify and restrict funds for capital improvements and affordable housing projects within Allapattah to assist with the revitalization and elimination of slum and blight in Allapattah; WHEREAS, pursuant to Part III, Chapter 163, Florida Statutes, there was created by action of Miami-Dade County (“County”) and the City the Omni Redevelopment District Community Redevelopment Agency (“Omni CRA”) within the boundary limits of the City; and WHEREAS, it is in the best interest of the City to authorize the City Manager to negotiate an interlocal agreement, in a form acceptable to the City Attorney, with the intent to claw back Two Million and 00/100 Dollars ($2,000,000.00) in tax increment funding revenues from the Omni CRA for the next five (fiscal years) beginning in Fiscal Year 2025-2026 to be restricted for capital improvements, infrastructure repairs and improvements, and affordable housing projects in Allapattah;

NOW, THEREFORE,

BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized1 to negotiate and execute an interlocal agreement, in a form acceptable to the City Attorney, with the intent to claw back Two Million and 00/100 Dollars ($2,000,000.00) in tax increment funding revenues from the Omni CRA for the next five (fiscal years) beginning in Fiscal Year 2025-2026 to be restricted for capital improvements, infrastructure repairs and improvements, and affordable housing projects in Allapattah. Section 3. The City Manager is further authorized1 to negotiate and execute any and all other documents necessary, including any modifications, extensions, and amendments, all in forms acceptable to the City Attorney, for said purpose. Section 4. This Resolution shall become effective immediately upon its adoption. APPROVED AS TO FORM AND CORRECTNESS: 1 The herein authorization is further subject to compliance with all legal requirements that may be imposed, including but not limited to, those prescribed by applicable City Charter and City Code provisions.
