041(3)(C)(2), FLORIDA STATUTES; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN IMMEDIATE EFFECTIVE DATE. WHEREAS,
041(3)(c)(2), Florida Statutes, requires two (2) advertised public hearings for certain zoning-related ordinances, with at least one hearing held after 5:00 p.m. on a weekday unless the governing body, by a majority-plus-one vote, elects to hold the hearing at another time; and WHEREAS, Section 2-32 of the Code of the City of Miami, Florida, as amended (“City Code”), currently requires such proposed ordinances to be held after 5:00 p.m. at any City Commission meeting and pursuant to
041(3)(c)(2), Florida Statutes, as amended; and WHEREAS, the City of Miami (“City”) seeks to remove this time-specific requirement from the City Code and instead rely on the provisions of
041(3)(c)(2), Florida Statutes, including the option to hold hearings at another time by a majority-plus-one vote; and WHEREAS, the City Commission finds that this amendment is necessary and in the best interests of the City and its residents, as it promotes efficiency and facilitates the timely consideration of essential ordinances;
NOW, THEREFORE,
BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Chapter 2/Article II, Section 2-32 of the City Code is further amended in the following particulars:1 “CHAPTER 2” ADMINISTRATION 1 Words and/or figures stricken through shall be deleted. City of Miami File ID: 18825 (Revision: ) Printed On: 3/3/2026 * * * ARTICLE II. MAYOR AND CITY COMMISSION * * * Sec. 2-32. Time and place of meeting. (a) City hall, located at 3500 Pan American Drive, Miami, Florida, is hereby designated as the meeting place for the city commission. All meetings of the city commission shall be held on the first floor of city hall. The city commission may designate alternate meeting places and times from time to time as may appear appropriate by resolution. Such resolution shall specify the date, time, and place and shall be limited to one city commission meeting per resolution. The date so specified shall be not sooner than 30 days subsequent to the effective date of the resolution. (b) Regular meetings of the city commission shall be held on the second and fourth Thursdays of each month beginning at 9:00 a.m. except the months of August, November, and December and unless otherwise provided by city commission action. During the month of November, the regular meeting shall be held on the third Thursday at 9:00 a.m. During the month of December, the regular meeting shall be held on the second Thursday at 9:00 a.m. Proposed ordinances changing the actual list of permitted, conditional, or prohibited uses within a zoning category or changes to the Zoning Atlas of the Miami 21 Code involving parcels of ten contiguous acres or more shall be held after 5:00 p.m. at any city commission meeting and pursuant to the provisions of F.S. § 166.041(3)(c)(2), as amended. The city commission shall be in recess during the month of August. (c) The city commission may, by resolution, designate a substitute day or time upon which regular city commission meetings shall be held whenever, in the opinion of a majority of the members of the city commission, there is good cause for such substitution. (d) Notwithstanding the foregoing, the Mayor, the presiding officer/chair, or three City Commissioners may cancel a regular city commission meeting at any time provided that written notice of the cancellation is delivered to the City Clerk at least 72 hours in advance. The City Clerk shall then notify the Mayor, each member of the commission, the City Manager, the City Attorney, and the public of the cancellation. Cancelled meetings shall be rescheduled pursuant to 2-33(o) of the City Code. * * *” Section 3. If any section, part of a section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 4. This Ordinance shall become effective immediately upon final reading and adoption thereof.2 2 This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten (10) days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is later.
