Background of Item: FDOT has developed design plans Financial Management (“FM”) Project No. FM 451049-1-52-01 for the construction of safety improvements, provision of midblock crosswalks at three locations, replacement of deficient pedestrian ramps, drainage improvements, signing, pavement markings, lighting and signalization improvements (“Project”). FDOT intends to undertake and complete the Project, a portion of which includes work on roads not on the State Highway System but City of Miami (“City”) right- of-way, specifically along NW 13 Avenue, 70 feet south and 65 feet north of the SR- 944/NW 54 Street centerline (for purposes of this agreement, the “Off-System Project Limits”). The Project includes installation of signalization pullboxes and conduits (“Local Roadway Improvements”) and all activities associated with, or arising out of the construction of the Local Roadway Improvements. The Off-System Construction and Maintenance Agreement (“Agreement”), attached and incorporated as Exhibit “A”, establishes the terms, conditions, and responsibilities of FDOT and the City to accomplish the Project and Local Roadway Improvements on the City’s Streets. WHEREAS, the Florida Department of Transportation (“FDOT”) has developed design plans Financial Management (“FM”) Project No. FM 451049-1-52-01 for the construction of safety improvements, provision of midblock crosswalks at three locations, replacement of deficient pedestrian ramps, drainage improvements, signing, pavement markings, lighting and signalization improvements (“Project”); and WHEREAS, FDOT intends to undertake and complete the Project, on State Road (“SR”) 944 / Northwest 54 Street from Northwest 32 Avenue to Northwest 12 Avenue, including work on Northwest 13 Avenue, a road not on the State Highway System, (for purposes of this agreement, the “Off-System Project Limits”); and WHEREAS, the City is the holder of ownership rights to Northwest 13 Avenue, which is a road not on the State Highway System; and WHEREAS, the Project includes installation of signalization pullboxes and conduits (“Local Roadway Improvements”) and all activities associated with, or arising out of the construction of the Local Roadway Improvements; and WHEREAS, the Off-System Construction and Maintenance Agreement (“Agreement”), in substantially the attached form, establishes the terms, conditions, and responsibilities of FDOT and the City of Miami (“City”) to accomplish the Project and Local Roadway Improvements on the City’s Streets; and WHEREAS, the City agrees with the terms and conditions in the Agreement, in substantially the form;

NOW, THEREFORE,

BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized1 to execute the Agreement, in substantially the attached form, with FDOT, for the Project on SR 944 / Northwest 54 Street from Northwest 32 Avenue to Northwest 12 Avenue, Miami, Florida, including work on Northwest 13 Avenue, a road not on the State Highway System, and the Local Roadway Improvements. Section 3. This Resolution shall become effective immediately upon its adoption. APPROVED AS TO FORM AND CORRECTNESS: 1 The herein authorization is further subject to compliance with all legal requirements that may be imposed, including but not limited to, those prescribed by applicable City Charter and City Code provisions.
