Background of Item: The Plat and Street Committee established per Miami City Code Section 55-1, and composed of the Departments of Resilience and Public Works, Planning, Building, Office of Zoning, Police, Fire-Rescue, and Solid Waste, with representation of the Law Department, has reviewed the Tentative Plat and determined its conformance to the subdivision regulations of Chapter 55, and Miami 21 Zoning Regulations. The Department of Resilience and Public Works has reviewed the final plat and has determined that it is now in order for consideration of acceptance by the Miami City Commission. The specific intent of this plat is to close a public utility easement within the boundaries of the proposed plat and create two (2) tracts of land for residential and commercial use. The plat entitled MCID 1 is a subdivision of the property described in the legal description shown as Attachment 1. The platted area consists of approximately 194,305 square feet (4.46 ± acres) as depicted in Exhibits B and C. This plat was approved under Miami 21 zoning designation T6-24-O and T6-12-O (Urban Transect Zone). WHEREAS, the Plat and Street Committee (“PSC”), established pursuant to Chapter 55 of the Code of the City of Miami, Florida, as amended (“City Code”), at its meeting of June 9, 2020, reviewed the proposed plat titled “MCID 1” and determined that all technical requirements have been met; and WHEREAS, the tentative plat’s expiration was extended from December 9, 2021 to June 26, 2023, due to the State of Emergency for Novel Coronavirus (“COVID-19”) pandemic and further extended to August 10, 2025, due to the State of Emergency for Tropical Depression Nine, and Subtropical Storm Nicole, pursuant to the provisions of

363, Florida Statutes; and WHEREAS, the PSC recommends the acceptance of the plat; and WHEREAS, the Miami Planning, Zoning and Appeals Board at its meeting on July 06, 2022, adopted Resolution No. PZAB-R-22-020 recommending approval with conditions of the vacation and closure of one (1) 326.33 foot long and six (6) foot wide platted utility easement bounded by Northeast 64 Terrace to the north, Florida East Coast Railway to the east, Northeast 62 Street to the south, and Northeast 2 Avenue to the west (“Vacation and Closure”); and WHEREAS, the Miami City Commission, at its meeting on September 22, 2022, adopted Resolution No. R-22-0369 approving with conditions said Vacation and Closure;

NOW, THEREFORE,

BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The plat titled “MCID 1,” a subdivision of the property described in Attachment “1,” which plat by reference, in substantially the attached form and subject to satisfaction of all conditions required by the PSC as set forth as Exhibit “A,” attached and incorporated, and the provisions contained in Section 55-8 of the City Code, is accepted. Section 3. The dedications shown on the plat together with the dedications to the perpetual use of the public of all existing and future planting, trees, and shrubbery on said dedications are hereby accepted and confirmed by the City of Miami. Section 4. The City Manager and City Clerk are authorized1 and directed to execute the aforesaid plat and cause the same to be recorded in the Public Records of Miami-Dade County, Florida. Section 5. This Resolution shall become effective immediately upon its adoption. APPROVED AS TO FORM AND CORRECTNESS: 1 The herein authorization is further subject to compliance with all legal requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and City Code provisions.
