RESOLUTION NO. 2022- A RESOLUTION OF THE VILLAGE OF PINECREST, FLORIDA, WAIVING THE COMPETITIVE BID REQUIREMENTS AND AUTHORIZING THE VILLAGE MANAGER TO ENTER INTO AN AGREEMENT WITH BROWN ESTATES, LLC. FOR THE PURCHASE OF TREES; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Village has experienced a loss of tree canopy due to the effects of Hurricane Irma in 2017, as well as the effects of ficus canker disease on mature street trees; and WHEREAS, the Village has identified a unique source for mature oak trees at a greatly discounted rate due to the vicinity of the trees;
BE IT RESOLVED BY THE VILLAGE COUNCIL OF PINECREST, FLORIDA, AS FOLLOWS: Section 1. That the Village Council hereby waives the procurement code requirements for competitive bidding for expenditures more than $50,000 and authorizes the Village Manager to execute an agreement with Brown Estates, LLC, for the purchase of twenty (20) large oak trees at a greatly discounted rate of $8,000 per tree. Section 2. This resolution shall take effect immediately upon adoption. PASSED AND ADOPTED this 8th day of June, 2022. Joseph M. Corradino, Mayor Attest: ____________________________ Priscilla Torres, CMC Village Clerk Approved as to Form and Legal Sufficiency: ____________________________ Mitchell Bierman Village Attorney Consent Agenda DATE: June 1, 2022 TO: The Honorable Mayor and Members of the Village Council FROM: Yocelyn Galiano, ICMA-CM, Village Manager RE: Resolution waiving the requirements of procurement code for tree purchase from Brown Estates, LLC A couple of months ago, the Village was approached by the property owner of an area (9170 SW 112 Street, Miami, FL 33176) that will be undergoing redevelopment about an opportunity to secure large oak trees at a greatly discounted rate. Over the course of these months, my office has been working to negotiate a deal that would allow for the purchase of twenty (20) trees directly from Brown Estate, LLC for a discounted cost of $8,000 per tree. The arrangement we have negotiated provides for the payment of an upfront tree relocation cost of $3,000 with the balance of $5,000 to be paid over three years (3-year installment plan) commencing on the anniversary date of the installation. Because of the relatively close location of the trees and the need for the developer to remove the trees in the near future, we were able to get this discounted rate. Typically, trees in comparable sizes would cost upwards of $15,000 each. These larger trees will replace much of the lost tree canopy the Village experienced during Hurricane Irma and due to disease affecting some of the larger ficus trees throughout that have been or will be removed in the near future. I hereby respectfully recommend the Village Council approve the attached resolution authorizing the Village Manager to waive the requirements of procurement code for purchase of the trees and authorizing the Village Manager to execute and agreement with the terms as described above. Funding for this initiative will be built into future budgets. /yg
