RESOLUTION NO. 2025- A RESOLUTION OF THE VILLAGE OF PINECREST, FLORIDA, RATIFYING THE RE-APPOINTMENT OF SPECIAL MAGISTRATES/HEARING OFFICERS PURSUANT TO SECTION 2-141 OF THE CODE OF ORDINANCES; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Section 2-141(d) of the Village Code of Ordinances requires that the mayor appoint special magistrates/hearing officers; and WHEREAS, the mayoral appointment is subject to Village Council ratification;

NOW, THEREFORE,

BE IT RESOLVED BY THE VILLAGE COUNCIL OF PINECREST, FLORIDA, AS FOLLOWS: Section 1. That the Village Council hereby ratifies the mayor’s appointment of the following to serve a one-year term as a Special Magistrate pursuant to the provisions of Section 2-141 of the Village’s Code of Ordinances: • Roy Weinfeld (Code Compliance) Section 2. Weinfeld The Village of Pinecrest currently has two appointed special magistrates who meet each month to adjudicate code compliance cases that are not resolved in the initial stages of the code compliance process after issuance of a code compliance reminder notice. To reduce the length of individual special magistrate hearing sessions and allow for less time between hearing agenda dates, the Building and Planning Department recommends the appointment of a third special magistrate. Article 5, Division 2 of the Village’s Code of Ordinances states that the appointment of a special magistrate shall be made by the mayor, subject to confirmation by the village council, as needed based on experience or interest in code compliance. Special magistrates are required to be licensed attorneys who are not residents of the Village. Following a telephone interview with three special magistrate candidates recommended by the Village Attorney, Esther Cabrera, Code Compliance Supervisor, and I interviewed two candidates in person. We are pleased to recommend the appointment of Mr. Roy L. Weinfeld as a special magistrate. A copy of Mr. Weinfeld’s resume and a letter of reference from the Miami Shores Village Neighborhood Services Manager, Michael Orta, are attached for your consideration.
