(2022-45) Vice Mayor Abbott made a motion adopting the consent agenda items. The motion was seconded by Councilmember Hochkammer and adopted by a unanimous voice vote. The vote was as follows: Councilmembers del Prado, Hochkammer, Kraft, Vice Mayor Abbott, and Mayor Corradino voting Yes. The following item was withdrawn from the consent agenda by Councilmember del Prado and considered separately by the Council: A RESOLUTION OF THE VILLAGE OF PINECREST, FLORIDA, AUTHORIZING THE USE OF FORFEITURE FUNDS FROM THE LAW ENFORCEMENT TRUST FUND; PROVIDING FOR AN EFFECTIVE DATE. The mayor opened the public hearing. There were no speakers. Councilmember Del Prado made a motion to adopt the resolution. The motion was seconded by Vice Mayor Abbott. Resolution 2022-46 was adopted by a unanimous voice vote. The vote was as follows: Councilmembers del Prado, Hochkammer, Kraft, Vice Mayor Abbott, and Mayor Corradino voting Yes. July 11, 2022 Village Council Meeting Page 3 of 7 #Pinecresting The following item was withdrawn from the consent agenda by Councilmember Hochkammer and considered separately by the Council: A RESOLUTION OF THE VILLAGE OF PINECREST, FLORIDA, AUTHORIZING THE VILLAGE MANAGER TO NEGOTIATE AND EXECUTE AN AGREEMENT WITH BEEFREE, LLC D/B/A FREEBEE FOR THE PROVISION OF ON-DEMAND TRANSPORTATION SERVICES UTILIZING THE TERMS AND CONDITIONS OF THE CITY OF AVENTURA CONTRACT AWARDED PURSUANT TO RFP NO. 20-07-23-3; AND PROVIDING FOR AN EFFECTIVE DATE. The mayor opened the public hearing. There were no speakers. Councilmember Hochkammer made a motion to adopt the resolution. The motion was seconded by Vice Mayor Abbott. AGENDA/ORDER OF BUSINESS: The following items were withdrawn from the agenda: Item V.1, and Item VI.A.1. The following item was added to the agenda under the manager’s reports and recommendations: Submission of 2022-2023 Capital and Operating Budget. V. REPORTS AND RECOMMENDATIONS: The Council designated Vice Mayor Abbott to serve as the Village’s voting delegate at the 2022 Florida League of Cities conference. The manager submitted the following communiqués and reports to the Council: June 2022 Follow-up Report Monthly Departmental Reports Freebee Update Employee Vaccination Update Palmetto Senior Development Review The manager, pursuant to
2(5) of the Village Charter, presented to the Council the proposed 2022-2023 Budget and made a brief presentation regarding highlights of the document. The manager presented a request from the property owner of 6700 Southwest 132 Street, for the mitigation of fines in the amount $141,174.48, pursuant to Sec. 2-150 of the Code of Ordinances. Steven Kane, representing the owner, addressed the Council. The mayor opened the public hearing. Charles Bibb, 13191 Southwest 72 Avenue, Pinecrest, addressed the Council. Councilmember Hochkammer made a motion to approve a $110,000 settlement negotiated by the attorney, with the condition that it be paid within 12 months or interest will start to accrue. The motion was seconded by Vice Mayor Abbott and adopted by unanimous consent. The manager submitted a presentation summarizing the Miami-Dade County RTZ ordinance, presented on first reading to the Board of County Commissioners on June 1, 2022. The clerk submitted the names of nominees for the 2022-2023 Youth Advisory Council. PLANNING: The following quasi-judicial proceedings were held by the Council, pursuant to Chapter 2 (Article VI) of the Code of Ordinances, at 7:00 p.m. time certain: All witnesses giving testimony were sworn-in by the clerk. HEARING #2022-0111-1. Kendall Imports, LLC (applicant) is requesting the Village Council’s final determination of architectural harmony and approval of their request to internally illuminate the existing entrance portal at the front of the Kendall Toyota automobile dealership, located at 10943 Pinecrest Parkway, Florida, within the BU-1A General Business Development, and BU-2, Special Business Development Zoning Districts. (Deferred from January 11, 2022, February 8, 2022, March 8, 2022, April 12, 2022, May 10, 2022, June 8, 2022, and July 11, 2022) Vice Mayor Abbott made a motion to defer the hearing to September 13, 2022. The motion was seconded by Councilmember del Prado and adopted by a unanimous voice call vote. The vote was as follows: Councilmembers del Prado, Hochkammer, Kraft, Vice Mayor Abbott, and Mayor Corradino voting Yes. HEARING #2022-0711-1. Camelot Luxury Homes (owner), and Guillermo J. Miranda (applicant) are requesting approval of a final subdivision plat (“Sylvester Palms”) for the re-subdivision of lots 1 and 2, less the south 167.5 feet, block 1 of South Mitchell Manors subdivision, said property located at 11400 SW 60 Avenue, Pinecrest, Florida, within the eu-1, residential estate zoning district. Proposed tract A: is 44,875 square feet in area. Francisco Garcia, representing the applicant, 5920 Southwest 83 Street, addressed the Council. Planning Director Steve Olmsted gave an oral report, based on staff’s memorandum of July 2, 2022, recommending approval subject to the following conditions: 1. Approval of installation of septic tanks by the Florida Department of Health and Miami- Dade County. 2. Indication of utility easements on the final plat and installation of utilities underground. 3. Installation of pedestrian sidewalks adjacent to the north side of SW 114 Street and the west side of SW 60 Avenue or payment in lieu of construction as required by the Administrative Official. 4. Approval of driveway connection permits by the Village of Pinecrest prior to the issuance of building permits. 5. Approval of a stormwater management plan for each new residence prior to the issuance of building permits. 6. Review and approval of a separate tree removal permit prior to the removal of any trees from the subject property or adjoining road right-of- way. Confirmation of the setting of lot corners and permanent reference monuments or submittal of a surety bond to the Village of Pinecrest in the amount of $100.00 per lot corner and $300.00 per PRM with a 25% contingency prior to recording of the final plat, if approved by the Village Council. The mayor opened the public hearing. Jason Wilson, 5925 Southwest 114 Terrace, Pinecrest, addressed the Council. Vice Mayor Abbott made a motion adopting staff’s recommendations. The motion was seconded by Councilmember Hochkammer and adopted by a 5 – 0 voice call vote. The vote was as follows: Councilmembers del Prado, Hochkammer, Kraft, Vice Mayor Abbott and Mayor Corradino voting Yes. HEARING #2022-0711-2. Victor Guardiola (owner) and Adriano Swift (applicant) are requesting approval of a conditional use permit to allow installation of outdoor lights adjacent to a proposed tennis court pursuant to the requirements of the Village’s Land Development Regulations, Division 5.25, tennis court/basketball court/outdoor recreational area lighting; in compliance with the criteria for a conditional use permit as provided in Division 3.3, Conditional Use Approval. The subject property is located at 13005 SW 61 Avenue, Pinecrest, Florida, within the EU-1, Residential Estate Zoning District. Victor Guardiola, the applicant, 13005 Southwest 61 Avenue, addressed the Council. Planning Director Steve Olmsted gave an oral report, based on staff’s memorandum of July 3, 2022, recommending approval of the request subject to the following conditions: 1. Review of plans and approval of an electrical permit by the Building and Planning Department prior to installation of light poles and shielded light fixtures. 2. Submittal of a revised photometric drawing indicating proposed levels of lighting at all property lines not to exceed 0.5 foot-candles. 3. All light fixtures shall be aimed downward, away from adjoining property lines, and fitted with shields to prevent glare. 4. Maintenance of the existing landscape buffer adjacent to the north, south, and east sides of the tennis court. 5. The maximum overall height of the light poles and fixtures shall not exceed 18 feet from natural grade to the top of the light fixtures. 6. Outdoor court lighting shall not be used between the hours of 10:00 p.m. and 8:00 a.m. 7. Submittal of a letter of compliance from a registered engineer or architect, prior to issuance of a certificate of use, stating that installation of the lights has been inspected under operating conditions and found to be consistent with the requirements of the Village’s Land Development Regulations.
