SPECIAL MEETING MINUTES TUESDAY, JUNE 11, 2024, 4:00 P.M. PINECREST MUNICIPAL CENTER/COUNCIL CHAMBER 12645 PINECREST PARKWAY PINECREST, FLORIDA The special meeting was called to order by the mayor at 4:00 p.m. Present were the following: Councilmember Katie Abbott Councilmember Ken Fairman Councilmember Anna Hochkammer Vice Mayor Shannon del Prado Mayor Joseph M. Corradino Village Manager Yocelyn Galiano Village Clerk Priscilla Torres Village Attorney Mitchell Bierman The mayor announced that the purpose of the Executive Session was to discuss a collective bargaining agreement between the Village and the Dade County Police Benevolent Association (PBA) and that the following individuals would be present at the session: • Members of the Village Council • Special Counsel Denise Heekin • Village Manager Yocelyn Galiano • Assistant Village Manager Angela Gasca • HR Manager Kathy Mainieri • Police Chief Jason Cohen • Village Attorney Mitchell Bierman The public meeting was recessed at 4:06 p.m. and the aforementioned individuals retreated to the Village Manager’s Conference Room for the Executive Session. CALL TO ORDER/ROLL CALL OF MEMBERS: The meeting was called to order by the mayor at 6:00 p.m. Present were the following: Councilmember Katie Abbott Councilmember Ken Fairman Councilmember Anna Hochkammer Vice Mayor Shannon del Prado Mayor Joseph M. CONSENT AGENDA: The following items were presented per the Council’s consent agenda policy pursuant to Ordinance 2014-6: • Minutes of May 7, 2024 (Regular Meeting) • A RESOLUTION OF THE VILLAGE OF PINECREST, FLORIDA, AUTHORIZING THE VILLAGE MANAGER TO NEGOTIATE A PROFESSIONAL SERVICES AGREEMENT WITH URBAN ROBOT ASSOCIATES FOR THE MAS PARK MASTER PLAN; PROVIDING FOR AN EFFECTIVE DATE. (2024-24) The mayor opened the public hearing. There were no speakers present. The motion was seconded by Vice Mayor del Prado and adopted by a unanimous voice vote. The following item was withdrawn from the consent agenda by Councilmember Fairman and considered separately by the Council: A RESOLUTION OF THE VILLAGE OF PINECREST, FLORIDA, AUTHORIZING THE VILLAGE MANAGER TO ENTER INTO A CONTRACT WITH ARROW ASPHALT & ENGINEERING, INC. FOR MILLING AND RESURFACING OF SUNILAND PLACE (ANNEX PARKING LOT); PROVIDING FOR AN EFFECTIVE DATE. The mayor opened the public hearing. There were no speakers present. Councilmember Hochkammer made a motion adopting the resolution. The motion was seconded by Councilmember Abbott. Resolution 2024-25 was adopted by a unanimous voice vote. FOR THE PINECREST COMMUNITY CENTER PARTITION WALLS REPLACEMENT; PROVIDING FOR AN EFFECTIVE DATE. The mayor opened the public hearing. There were no speakers present. Councilmember Hochkammer made a motion adopting the resolution. The motion was seconded by Councilmember Abbott. Resolution 2024-26 was adopted by a unanimous voice vote. The mayor opened the public hearing. There were no speakers present. Vice Mayor del Prado made a motion adopting the resolution. The motion was seconded by Councilmember Hochkammer. Resolution 2024-27 was adopted by a unanimous voice vote. The vote was as follows: Councilmembers Abbott, Fairman, Hochkammer, Vice Mayor del Prado, and Mayor Corradino voting Yes. The following item was withdrawn from the consent agenda by Councilmember Fairman and considered separately by the Council: A RESOLUTION OF THE VILLAGE OF PINECREST, FLORIDA, ACCEPTING THE BCC ENGINEERING VULNERABILITY ASSESSMENT; PROVIDING FOR AN EFFECTIVE DATE. The mayor opened the public hearing. There were no speakers present. Vice Mayor del Prado made a motion adopting the resolution. The motion was seconded by Councilmember Hochkammer. Resolution 2024-28 was adopted by a unanimous voice vote. The vote was as follows: Councilmembers Abbott, Fairman, Hochkammer, Vice Mayor del Prado, and Mayor Corradino voting Yes. IV. AGENDA/ORDER OF BUSINESS: Councilmember Fairman requested Items VII.A.1 and VII.A.2 to be changed to items V.5 and V.6 respectively. The Council agreed by unanimous consent. V. SPECIAL PRESENTATIONS: Vice Mayor del Prado, on behalf of the Council, presented a proclamation to raise awareness about gun violence. The mayor, on behalf of the Council, presented a proclamation to Edison Cruz, in recognition of his service as an employee of the Village of Pinecrest. June 11, 2024 Village Council Meeting Page 4 of 8 #Pinecresting Javier Betancourt, Executive Director of the Citizens’ Independent Transportation Trust (CITT), and Mariana Price, also with CITT, made a presentation regarding the People’s Transportation Plan and the use of the transit tax monies. Dr. Jazmin Locke-Rodriguez, Post-Doctoral Researcher with FIU Agroecology Program, made a presentation regarding productive floating wetlands to help clean lakes and canals to support the health of Biscayne Bay Watershed. The Council unanimously authorized the manager to seek potential pilot money through grant applications and sustainability fund. Councilmember Fairman introduced resident Samantha Jones, who presented the Pinecrest Native Plant of the Month. Councilmember Abbott had a discussion proposing installation of a sidewalk along SW 62 Avenue. The Council unanimously authorized the manager to include it in the priorities for FY25 budget discussion. VI. ORDINANCES: The Council discussed the following ordinance on first reading: AN ORDINANCE OF THE VILLAGE OF PINECREST, FLORIDA, AMENDING THE PINECREST CODE OF ORDINANCES, CHAPTER 30, LAND DEVELOPMENT REGULATIONS, ARTICLE 5, ADDITIONAL REGULATIONS, DIVISION 5.15, OPEN AIR CAFÉ IN CONJUNCTION WITH A RESTAURANT, REVISING LOCATION, DESIGN, AND OPERATION REQUIREMENTS FOR ESTABLISHMENT OF OUTDOOR DINING; AND ARTICLE 7, SIGNS, DIVISION 7.13, PROHIBITED SIGNS, AND DIVISION 7.16, SIGN STANDARDS AND REQUIREMENTS TO ALLOW NON-COMMERCIAL FREESTANDING ELECTRONIC AND CHANGEABLE COPY MONUMENT SIGNS IN THE PS, PUBLIC AND SEMI-PUBLIC SERVICES ZONING DISTRICT; PROVIDING FOR INCLUSION IN THE CODE OF ORDINANCES; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. The planning director and Carlos Gazitua, owner of Sergio’s restaurant, addressed the Council. June 11, 2024 Village Council Meeting Page 5 of 8 #Pinecresting The mayor opened the public hearing. The following addressed the Council: Peter Casablanca, 7600 Southwest 134 Street, and Ariel Meyer, 10025 Southwest 58 Avenue, Pinecrest. Councilmember Hochkammer made a motion to approve the Ordinance on First Reading with amendments. The motion was withdrawn. Councilmember Abbott made a motion to bifurcate the issues into Article 5 and Article 7. The motion was seconded by Vice Mayor del Prado and adopted unanimously by a voice vote. Councilmember Abbott made a motion to approve Article 5 on First Reading as amended, incorporating the comments that were raised regarding noise and bike racks. The motion was seconded by Councilmember Fairman and adopted by a 5 – 0 roll call vote as follows: Councilmembers Abbott, Fairman, Hochkammer, Vice Mayor del Prado and Mayor Corradino voting Yes. Councilmember Hochkammer made a motion to approve Article 7 on First Reading with the addition of the following amendments: Limitation on the color, movability of the message, and time limit. Councilmember Fairman suggested to add an additional amendment regarding style restrictions. After Council discussion, Councilmember Fairman withdrew his suggestion. The Hochkammer motion was seconded by Councilmember Fairman and adopted by a 4 – 1 roll call vote as follows: Councilmembers Fairman, Hochkammer, Vice Mayor del Prado and Mayor Corradino voting Yes; Councilmember Abbott voting No. The clerk announced the second reading for July 9, 2024. VII. REPORTS AND RECOMMENDATIONS: The manager submitted the following communiqués and reports to the Council: • May 2024 Follow-up Report • Monthly Departmental Reports • Freebee Update • Peafowl Update June 11, 2024 Village Council Meeting Page 6 of 8 #Pinecresting The manager provided an update relating to the following matters: • SW 136 Street bridge project (expected start date June 11, 2024) • Street tree planting at public schools (pending approval from the schools) • Kendall Drive Shared Use Path project (pending approval by FDOT) Councilmember Fairman highlighted police operations from their monthly report and acknowledged the police chief. Councilmember Abbott expressed gratitude to the Parks and Recreation for their time and effort in preparing and completing the accreditation application. The manager provided a presentation regarding the FY2025 Stormwater Fee Study, dated June 7th, 2024, as prepared by SCS Engineers, the Village’s consultant. Vita Quinn, representing SCS Engineers, addressed the Council. Councilmember Abbott made a motion adopting the final proposed fee structure. The motion was seconded by Councilmember Hochkammer and adopted by a unanimous vote. The vote was as follows: Councilmembers Abbott, Fairman, Hochkammer, Vice Mayor del Prado, and Mayor Corradino voting Yes. The clerk submitted a copy of the minutes of the Zoning Board meeting of May 29, 2024. The Council scheduled a workshop for August 27, 2024 at 9:00 a.m. The Council scheduled a meeting for September 10, 2024 at 6:00 p.m. The Council scheduled a special meeting for September 17, 2024 at 5:01 p.m. The attorney provided an update on the litigation matter regarding Form 6. A Federal Court granted a preliminary injunction that changes the form filing requirement from a 2023 Form 6 back to a 2023 Form 1 for Mayors and City/Village/Town Governing Board Members. VIII. RESOLUTIONS: The Council discussed the following resolution: A RESOLUTION OF THE VILLAGE OF PINECREST, FLORIDA, PROVIDING FOR THE SUBMISSION TO THE VILLAGE ELECTORS FOR APPROVAL OR DISAPPROVAL OF A SERIES OF PROPOSED AMENDMENTS TO THE VILLAGE CHARTER, AS PROVIDED BY THE CHARTER REVISION COMMISSION REPORT, June 11, 2024 Village Council Meeting Page 7 of 8 #Pinecresting IN ACCORDANCE WITH

SECTION 6.

1(C) OF THE VILLAGE CHARTER; PROVIDING REQUISITE BALLOT LANGUAGE FOR SUBMISSION OF THE CHARTER AMENDMENTS TO THE ELECTORATE; CALLING A SPECIAL ELECTION ON THE PROPOSED CHARTER AMENDMENTS TO BE HELD ON TUESDAY THE 5TH DAY OF NOVEMBER, 2024, IN CONJUNCTION WITH THE GENERAL ELECTION BEING HELD ON SAID DATE; PROVIDING FOR REQUISITE BALLOT LANGUAGE; PROVIDING FOR VOTING AT THE POLLS; PROVIDING FOR NOTICE OF ELECTION; PROVIDING FOR INCLUSION IN THE CHARTER; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. The attorney addressed the Council. The mayor opened the public hearing. The following addressed the Council: Joe Corradino, 6485 Southwest 132 Street, Pinecrest. Vice Mayor del Prado made a motion adopting the resolution. The motion was seconded by Councilmember Abbott. Resolution 2024-29 was adopted by a 5 – 0 voice vote. The vote was as follows: Councilmembers Abbott, Fairman, Hochkammer, Vice Mayor del Prado and Mayor Corradino voting Yes. IX. PLANNING: The following proceedings were held by the Council, pursuant to Chapter 2 (Article VI) of the Code of Ordinances, at 7:00 p.m. time certain. All witnesses giving testimony in the following quasi-judicial proceedings were sworn-in by the village clerk. HEARING #2024-0611-1. GATOR DADELAND PARTNERS, LTD. (OWNER); AND RICH LADIES LLC., DBA THE THOUSAND SUNNY RESTAURANT (APPLICANT) ARE REQUESTING APPROVAL OF A CONDITIONAL USE PERMIT (SALE OF ALCOHOL FOR CONSUMPTION ON THE PREMISES) TO ALLOW THE ON-PREMISE CONSUMPTION OF BEER AND WINE (2-COP LICENSE) WITHIN THE DADELAND PLAZA SHOPPING CENTER, LOCATED AT 9545 PINECREST PARKWAY. Bin Chen, the applicant, addressed the Council. Planning Director Stephen Olmsted gave an oral report, based on staff’s memorandum of June 3, 2024, recommending approval of the request.
