(2022-51) Councilmember del Prado made a motion adopting the consent agenda items. The motion was seconded by Councilmember Hochkammer and adopted by a unanimous voice vote. The vote was as follows: Councilmembers del Prado, Hochkammer, Kraft, Vice Mayor Abbott, and Mayor Corradino voting Yes. The following item was withdrawn from the consent agenda by Councilmember Hochkammer and considered separately by the Council: A RESOLUTION OF THE VILLAGE OF PINECREST, FLORIDA, AUTHORIZING THE VILLAGE MANAGER TO EXECUTE AN AMENDMENT TO THE STANTEC AGREEMENT FOR THE POTABLE WATER DISTRIBUTION NETWORK CONSTRUCTION PROJECT ADMINISTRATION; PROVIDING FOR AN EFFECTIVE DATE. The mayor opened the public hearing. There were no speakers. Councilmember Hochkammer made a motion to adopt the resolution. The motion was seconded by Vice Mayor Abbott. Resolution 2022-52 was adopted by a unanimous voice vote. The vote was as follows: Councilmembers del Prado, Hochkammer, Kraft, Vice Mayor Abbott, and Mayor Corradino voting Yes. IV. AGENDA/ORDER OF BUSINESS: There were no changes to the agenda. V. SPECIAL PRESENTATIONS: There were no presentations. VI. BUDGET HEARING: The Council discussed the following matters relating to the 2022-2023 Operating and Capital Budget at 6:00 p.m. time certain: The manager made a brief presentation regarding the millage rate and proposed budget. The Council discussed the following resolution: A RESOLUTION OF THE VILLAGE OF PINECREST, FLORIDA, ADOPTING THE TENTATIVE MILLAGE RATE OF THE VILLAGE OF PINECREST FOR THE FISCAL YEAR COMMENCING OCTOBER 1, 2022 PURSUANT TO FLORIDA STATUTE 200.065 (TRIM BILL); SETTING A DATE FOR A FINAL PUBLIC HEARING TO ADOPT THE FINAL MILLAGE RATE; PROVIDING FOR PUBLICATION OF PUBLIC NOTICE; PROVIDING FOR AN EFFECTIVE DATE. September 13, 2022 Village Council Meeting Page 3 of 7 #Pinecresting The clerk announced that the proposed tentative millage rate of 2.3500 was 11.24% greater than the roll-back rate of 2.1125. The mayor opened the public hearing. There were no speakers present. Councilmember del Prado made a motion adopting the resolution and setting the millage rate at 2.35. The motion was seconded by Vice Mayor Abbott. Resolution 2020-49 was adopted by a 5 – 0 roll call vote. The vote was as follows: Councilmembers del Prado, Hochkammer, Kraft, Vice Mayor Abbott, and Mayor Corradino voting Yes. The clerk announced that the public hearing to adopt the final millage rate is scheduled for September 22, 2022. The clerk read the following ordinance, on first reading, by title: AN ORDINANCE OF THE VILLAGE OF PINECREST, FLORIDA, ADOPTING AN OPERATING AND CAPITAL OUTLAY BUDGET FOR THE FISCAL YEAR COMMENCING OCTOBER 1, 2022 THROUGH SEPTEMBER 30, 2023 PURSUANT TO FLORIDA STATUTE 200.065 (TRIM BILL); UPDATING THE CAPITAL IMPROVEMENT SCHEDULE; PROVIDING FOR AN EFFECTIVE DATE. The mayor opened the public hearing. The following addressed the Council: Jeffrey Granoff, 9601 Southwest 68 Avenue; Laura McNaughton, 13401 Southwest 74 Avenue; Juan Cardenal, 8101 Southwest 124 Street; Susan Granoff, 9601 Southwest 68 Avenue; Terry Buria, 13432 Southwest 83 Avenue; Sandra Bielfield, 10720 Southwest 74 Court; Miguel Rebollar, 6220 Moss Ranch Road; Maria Hiers, 12645 Southwest 81 Avenue; and Paula Hamelik, 12801 Southwest 82 Place. Vice Mayor Abbott made a motion adopting the ordinance on first reading. The motion was seconded by Councilmember Hochkammer and adopted by a unanimous roll call vote. REPORTS AND RECOMMENDATIONS: Councilmember Kraft discussed possible amendments to the Village’s Land Development Regulations. Planning Director Steve Olmsted gave an oral report, based on staff’s memorandum of September 6, 2022. Public Works Director David Mendez, addressed the Council. By unanimous consent, the Council directed staff to draft amendments for future consideration. Robert Fernandez, attorney representing the village, addressed the Council. Ralph Brookes, attorney representing the Petitioner’s Committee, addressed the Council. The Council directed the attorney to review the proposed ballot question language for legal sufficiency. IX. RESOLUTIONS: The Council discussed the following resolution: A RESOLUTION OF THE VILLAGE OF PINECREST, FLORIDA, SUPPORTING THE BASING OF THE F-35 LIGHTNING AIRCRAFT AT THE HOMESTEAD AIR RESERVE BASE AND REQUESTING THE SUPPORT OF SOUTH FLORIDA’S FEDERAL LEGISLATIVE DELEGATION FOR THE IMPLEMENTATION OF PLANNING AND FUNDING FOR THE SAME; PROVIDING FOR TRANSMITTAL; AND PROVIDING FOR AN EFFECTIVE DATE. Councilmember Hochkammer made a motion adopting the resolution. The resolution was seconded by Vice Mayor Abbott. Resolution 2022-53 was adopted by a unanimous voice vote. PLANNING: The following quasi-judicial proceedings were held by the Council, pursuant to Chapter 2 (Article VI) of the Code of Ordinances, at 7:00 p.m. time certain: All witnesses giving testimony were sworn-in by the clerk. HEARING #2022-0111-1. Kendall Imports, LLC (applicant) is requesting the Village Council’s final determination of architectural harmony and approval of their request to internally illuminate the existing entrance portal at the front of the Kendall Toyota automobile dealership, located at 10943 Pinecrest Parkway, Florida, within the BU- 1A General Business Development, and BU-2, Special Business Development Zoning Districts. (Deferred from January 11, 2022, February 8, 2022, March 8, 2022, April 12, 2022, May 10, 2022, June 8, 2022, and July 11, 2022) Councilmember Kraft made a motion to defer the hearing to October 11, 2022. The motion was seconded by Councilmember del Prado and adopted by a unanimous voice call vote. Crimson Ibis, LLC (owner), and Lou Campanile, Jr. (applicant) are requesting approval of a Preliminary Subdivision Plat (“Crimson Ibis”) for the division of property and creation of two (2) single-family residential lots on property located at 9300 SW 60 Court, Pinecrest, Florida, within the EU-1, Residential Estate Zoning District. Lot 1 is proposed to be 1.625 acres in net area; and Lot 2 is proposed to be 2.619 acres in net area. Lou Campanile, Jr., the applicant, addressed the Council. Planning Director Steve Olmsted gave an oral report, based on staff’s memorandum of September 6, 2022, recommending approval subject to the following conditions: 1. Extension of County water to the subject property prior to approval of the final subdivision plat. 2. Installation of fire hydrants in compliance with the Village’s fire hydrant spacing requirements prior to approval of the final subdivision plat. 3. Approval of installation of septic tanks by the Florida Department of Health and Miami-Dade County. 4. Indication of utility easements on the final plat and installation of utilities underground. 5. Installation of pedestrian sidewalks adjacent to the west side of SW 60 Court or payment in lieu of construction as required by the Administrative Official. 6. Approval of driveway connection permits by the Village of Pinecrest prior to the issuance of building permits. 7. Approval of a stormwater management plan prior to the issuance of building permits. 8. Review and approval of a separate tree removal permit prior to the removal of any trees from the subject property or adjoining road right-of-way. 9. Confirmation of the setting of lot corners and permanent reference monuments or submittal of a surety bond to the Village of Pinecrest in the amount of $100.00 per lot corner and $300.00 per PRM with a 25% contingency prior to recording of the final plat, if approved by the Village Council. Andrew Axelrad, representing the PBA, made a presentation to the Council regarding the PBA’s proposal in the collective bargaining agreement. Steadman Stahl, the president of the PBA, also addressed the Council. The Council presented a proclamation to outgoing Pinecrest Gardens Director Alana Perez in recognition of her service to the community. Melissa Hege, of MHCP COLAB, the Village’s consultant, made a presentation regarding the proposed Pinecrest Parkway (US 1) Vision Plan Update. The following addressed the Council: PPCC Chairperson Medina, Jeffrey Granoff, 9601 Southwest 68 Avenue; PPCC Member Sawhney; PPCC Member Casanova; Lance Kyle, 7475 Southwest 102 Street; Laura McNaughton, 13401 Southwest 74 Avenue; Patricia Brid, 6280 North Kendall Drive; Maria Hiers, 12645 Southwest 81 Avenue; Harry Speizer, 10001 Southwest 70 Avenue; and PPCC Member Farrar. The Council directed the manager to provide recommendations to the Land Development Regulations at the next council meeting. The manager addressed the Council regarding peacocks in the village. The Council directed the manager to implement a pilot program to stop the birds from reproducing.
