REGULAR MEETING MINUTES TUESDAY, JUNE 13, 2023, 6:00 P.M. PINECREST MUNICIPAL CENTER/COUNCIL CHAMBER 12645 PINECREST PARKWAY PINECREST, FLORIDA I. CALL TO ORDER/ROLL CALL OF MEMBERS: The meeting was called to order by the mayor at 6:00 p.m. Present were the following: Councilmember Katie Abbott (via Zoom) Councilmember Shannon del Prado Councilmember Ken Fairman Vice Mayor Anna Hochkammer Mayor Joseph M. (2023-48) The mayor opened the public hearing. There were no speakers present. Vice Mayor Hochkammer made a motion adopting the consent agenda items. The motion was seconded by Councilmember del Prado and adopted by a unanimous voice vote. The vote was as follows: Councilmembers Abbott, del Prado, Fairman, Vice Mayor Hochkammer, and Mayor Corradino voting Yes. The motion was seconded by Vice Mayor Hochkammer. Resolution 2023-49 was adopted by a unanimous voice vote. The vote was as follows: Councilmembers Abbott, del Prado, Fairman, Vice Mayor Hochkammer, and Mayor Corradino voting Yes. IV. AGENDA/ORDER OF BUSINESS: There were no changes to the agenda. V. SPECIAL PRESENTATIONS: State Representative Alina Garcia provided the Council a legislative update. County Commissioner Raquel Regalado addressed the Council regarding her commitment for the funding and support of the peafowl mitigation policy as prepared by the Village. VI. ORDINANCES: The Council discussed the following ordinance on first reading: AN ORDINANCE OF THE VILLAGE OF PINECREST, FLORIDA, AMENDING THE 2022-2023 OPERATING AND CAPITAL OUTLAY BUDGET (2nd QUARTER); PROVIDING FOR AN EFFECTIVE DATE. The manager addressed the Council. The mayor opened the public hearing. There were no speakers. Councilmember del Prado made a motion to approve the ordinance on First Reading as amended. The motion was seconded by Councilmember Abbott and adopted by a roll call vote as follows: Councilmembers Abbott, del Prado, Fairman, Vice Mayor Hochkammer, and Mayor Corradino voting Yes. The clerk announced the second reading for July 18, 2023. The Council discussed the following ordinance on first reading: AN ORDINANCE OF THE VILLAGE OF PINECREST, FLORIDA, AMENDING THE VILLAGE CODE OF ORDINANCES, CHAPTER 15, NUISANCES, ARTICLE 1, IN GENERAL, BY CREATING SECTION 15-4, OBSTRUCTING PASSAGE ON STREETS, SIDEWALKS, AND BICYCLE PATHS PROHIBITED; PROVIDING FOR CODIFICATION; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. The motion was seconded by Councilmember del Prado and adopted by a unanimous roll call vote. The vote was as follows: Councilmembers Abbott, del Prado, Fairman, Vice Mayor Hochkammer, and Mayor Corradino voting Yes. The clerk announced the second reading for July 18, 2023 The Council discussed the following ordinance on first reading: AN ORDINANCE OF THE VILLAGE OF PINECREST, FLORIDA, AMENDING THE VILLAGE CODE OF ORDINANCES, CHAPTER 15, NUISANCES, ARTICLE 1, IN GENERAL, BY CREATING DIVISION 15-5, CAMPING PROHIBITED; PROVIDING FOR CODIFICATION; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. The attorney addressed the Council. The mayor opened the public hearing. There were no speakers. Councilmember del Prado made a motion to approve the ordinance on First Reading. REPORTS AND RECOMMENDATIONS: The manager provided an update at the mayor’s request regarding the sidewalk on SW 102 Street, SW 57 Avenue, and SW 67 Avenue. June 13, 2023 Village Council Meeting Page 5 of 9 #Pinecresting The manager submitted the following communiqués and reports to the Council: • May 2023 Follow-up Report • Monthly Departmental Reports • Freebee Update • Employee Vaccination update The manager and Pinecrest Gardens Director Cristina Blanco provided the Council with an update regarding the animatronics historic project and possible partnership with University of Florida to take on an interdisciplinary history project. The manager and Alana Perez, the Village’s cultural arts consultant, addressed the Council and presented the selection proposal for the artists for the two roundabouts at SW 136 Street. The following addressed the Council: Michael Guilford, 5800 Southwest 108 Street; Gary Simon, 6465 Southwest 110 Street; Hugo Blanco, 7400 Southwest 98 Street; Maria Hiers, 12645 Southwest 81 Avenue; and Charles Yeiser, 7955 Southwest 131 Street, Pinecrest. The Council unanimously directed the manager to select the artists for the two roundabouts at SW 136 Street. The clerk submitted a copy of the following proclamations issued by the mayor pursuant to Resolution 96-32: • Panther Tennis Day (May 31, 2023) The clerk informed the Council that the Village’s voting delegate will be designated during the July meeting. The clerk provided the Council with the County and School Board hearing dates so they may choose the dates for the September Budget Hearing dates during the July meeting. VIII. RESOLUTIONS: The Council discussed the following resolution: A RESOLUTION OF THE VILLAGE OF PINECREST, FLORIDA, MODIFYING EXISTING RESTRICTIONS RELATING TO NIGHT-TIME PARTIES WITH ALCOHOL AT PINECREST GARDENS TO EXCLUDE FROM THE RESTRICTIONS PARTIES HELD AT INDOOR FACILITIES AT THE VENUE; PROVIDING FOR AN EFFECTIVE DATE. (DEFERRED FROM MAY 9, 2023). June 13, 2023 Village Council Meeting Page 6 of 9 #Pinecresting The mayor opened the public hearing. Michael Guilford, 5800 Southwest 108 Street; Gary Simon, 6465 Southwest 110 Street; Charles Yeiser, 7955 Southwest 131 Street; Maria Kasner, 1560 Lugo Avenue, Coral Gables; Angel Gallinal, 5820 Southwest 111 Terrace; Helene Kronberg, 5845 Southwest 111 Terrace; and Alana Perez, 6790 Southwest 122 Drive, Pinecrest. Councilmember Abbott made a motion to approve the resolution. The motion was seconded by Councilmember Fairman. Resolution 2023-50 was adopted by a 5 – 0 Voice vote. The vote was as follows: Councilmembers Abbott, del Prado, Fairman, Vice Mayor Hochkammer, and Mayor Corradino voting Yes. Councilmember Fairman made a motion instructing the manager to ensure that there is an accessible water supply at no cost to all guests at all functions serving alcohol. The mayor opened the public hearing. There were no speakers. The motion was seconded by Vice Mayor Hochkammer and adopted by a unanimous voice vote. The Council discussed the following resolution: A RESOLUTION OF THE VILLAGE OF PINECREST, FLORIDA, ESTABLISHING THE ARCHITECTURAL REVIEW BOARD AND PROVIDING FOR MEMBERSHIP; PROVIDING FOR MISSION; PROVIDING FOR OFFICERS, MEETINGS AND REPORTS; PROVIDING FOR AN EFFECTIVE DATE. The mayor opened the public hearing. There were no speakers. Councilmember del Prado made a motion to approve the resolution. The motion was seconded by Vice Mayor Hochkammer. Resolution 2023-51 was adopted by a 5 – 0 Voice vote. The vote was as follows: Councilmembers Abbott, del Prado, Fairman, Vice Mayor Hochkammer, and Mayor Corradino voting Yes. The Council discussed the following resolution: A RESOLUTION OF THE VILLAGE OF PINECREST, FLORIDA, RESOLUTION OF THE VILLAGE OF PINECREST, FLORIDA, APPROVING A PEAFOWL MITIGATION POLICY AND DIRECTING VILLAGE STAFF TO TRANSMIT SAID POLICY TO THE MIAMI-DADE COUNTY BOARD OF COUNTY COMMISSIONERS FOR APPROVAL PURSUANT TO THE MIAMI-DADE COUNTY CODE, CHAPTER 5 “ANIMALS AND FOWL”, SECTION 5-16 “TAKING OF PEAFOWL PROHIBITED”; PROVIDING FOR AN EFFECTIVE DATE. Councilmember del Prado made a motion to approve the resolution. The motion was seconded by Councilmember Abbott. Resolution 2023-52 was adopted by a 5 – 0 Voice vote. The vote was as follows: Councilmembers Abbott, del Prado, Fairman, Vice Mayor Hochkammer, and Mayor Corradino voting Yes. The Council discussed the following resolution: A RESOLUTION OF THE VILLAGE OF PINECREST, FLORIDA, WAIVING THE COMPETITIVE BID REQUIREMENTS AND AUTHORIZING THE VILLAGE MANAGER TO ENTER INTO AN AGREEMENT WITH _________ FOR 136 ST ROUNDABOUT SCULPTURE; PROVIDING FOR AN EFFECTIVE DATE. PLANNING: The following proceeding was held by the Council, pursuant to Chapter 2 (Article VI) of the Code of Ordinances, at 7:00 p.m. time certain. All witnesses giving testimony were sworn-in by the clerk. Hearing #2023-0613-1. LTDI IV, LLC, dba La Taberna de Ignacio, is requesting approval of a Conditional Use permit (“Sale of alcoholic beverages for consumption on the premises”) for the on-premise consumption of beer, wine, and spirits (4 COP License) in a restaurant located at 9511 Pinecrest Parkway, Pinecrest, Florida 33156 within the BU-2, Special Business Development Zoning District. Zunay Rabelo, representing the applicant, addressed the Council. Planning Director Stephen Olmsted gave an oral report, based on staff’s memorandum of June 5, 2023, recommending approval of the requested conditional use for the sale of beer, wine and spirits (4-COP License) for consumption on the premises. The mayor opened the public hearing. There were no speakers. Vice Mayor Hochkammer made a motion to approve the hearing as requested. The motion was seconded by Councilmember Abbott and adopted by a unanimous Voice vote.
