(2023- 92) The mayor opened the public hearing. The following addressed the Council: Bob Ross, 6701 Southwest 94 Street; and Jackie Bofill, 11220 Southwest 67 Avenue, Pinecrest. Councilmember Hochkammer made a motion adopting the consent agenda items. The motion was seconded by Councilmember Abbott and adopted by a unanimous voice vote. The vote was as follows: Councilmembers Abbott, Fairman, Hochkammer, Vice Mayor del Prado and Mayor Corradino voting Yes. The following item was withdrawn from the consent agenda by the manager: RESOLUTION OF THE VILLAGE OF PINECREST, FLORIDA, AUTHORIZING THE VILLAGE MANAGER TO ENTER INTO AN AGREEMENT WITH METRO EXPRESS FOR CONSTRUCTION OF A FIRE ACCESS ROAD FROM THE PUBLIC WORKS YARD TO THE COMMUNITY CENTER FIELD; PROVIDING FOR AN EFFECTIVE DATE. The following item was withdrawn from the consent agenda by Councilmember Fairman and considered separately by the Council: A RESOLUTION OF THE VILLAGE OF PINECREST, FLORIDA, AUTHORIZING THE VILLAGE MANAGER TO ENTER INTO AN AGREEMENT WITH STANTEC FOR VILLAGE-WIDE PAVEMENT CONDITION SURVEY AND REHABILITATION & MAINTENANCE PLAN; PROVIDING FOR AN EFFECTIVE DATE. Public Works Director David Mendez addressed the Council. The mayor opened the public hearing. There were no speakers. Councilmember Hochkammer made a motion adopting the resolution. The motion was seconded by Councilmember Abbott. Resolution 2023-94 was adopted by a unanimous voice vote. The vote was as follows: Councilmembers Abbott, Fairman, Hochkammer, Vice Mayor del Prado and Mayor Corradino voting Yes. IV. AGENDA/ORDER OF BUSINESS: There were no changes to the agenda. V. SPECIAL PRESENTATIONS: Robert Meyers, representing the Village’s Attorney, provided the Council a presentation regarding financial disclosure requirements. VI. ORDINANCES: The Council discussed the following ordinance on first reading: AN ORDINANCE OF THE VILLAGE OF PINECREST, FLORIDA, CREATING SECTION 36-4 OF THE VILLAGE CODE OF ORDINANCES TO AUTHORIZE THE PLACEMENT, INSTALLATION, AND OPERATION OF SPEED DETECTION SYSTEMS ON ROADWAYS MAINTAINED AS SCHOOL ZONES, ESTABLISH TRAFFIC ENFORCEMENT PROCEDURES WHEN SPEED DETECTION SYSTEMS ARE UTILIZED FOR SCHOOL ZONE SPEED LIMIT VIOLATIONS, AND CREATE HEARING PROCEDURES RELATING TO SUCH SCHOOL ZONE SPEED LIMIT VIOLATIONS; PROVIDING FOR IMPLEMENTATION; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS; PROVIDING FOR CODIFICATION; AND PROVIDING FOR AN EFFECTIVE DATE. Councilmember Fairman made a motion to approve the ordinance on First Reading. The motion was seconded by Councilmember Abbott and adopted by a unanimous roll call vote as follows: Councilmembers Abbott, Fairman, Hochkammer, Vice Mayor del Prado, and Mayor Corradino voting Yes. The clerk announced the second reading for January 9, 2024. The Council discussed the following ordinance on second reading: AN ORDINANCE OF THE VILLAGE OF PINECREST, FLORIDA, AMENDING THE 2022-2023 OPERATING AND CAPITAL OUTLAY BUDGET (4th QUARTER); PROVIDING FOR AN EFFECTIVE DATE. The manager addressed the Council. The mayor opened the public hearing. There were no speakers. Councilmember Hochkammer made a motion to approve the ordinance on Second Reading. The motion was seconded by Vice Mayor del Prado. Ordinance 2023-13 was adopted by a unanimous roll call vote. The vote was as follows: Councilmembers Abbott, Fairman, Hochkammer, Vice Mayor del Prado, and Mayor Corradino voting Yes. The Council discussed the following ordinance on second reading: AN ORDINANCE OF THE VILLAGE OF PINECREST, FLORIDA, AMENDING SECTION 2-290, “PURCHASING LIMITATIONS; COMPETITIVE BIDDING,” OF CHAPTER 2 OF THE VILLAGE CODE OF ORDINANCES TO MODIFY COMPETITIVE BIDDING THRESHOLDS AND METHODS; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS; PROVIDING FOR CODIFICATION; AND PROVIDING FOR AN EFFECTIVE DATE. The manager addressed the Council. The mayor opened the public hearing. There were no speakers. REPORTS AND RECOMMENDATIONS: Councilmember Abbott, on behalf of the Youth Advisory Council, invited the Council to their annual dinner prior to the January Council meeting. The manager submitted the following communiqués and reports to the Council: • November 2023 Follow-up Report • Monthly Departmental Reports • Freebee Update • Peacock Mitigation Program Update The manager gave an update regarding the process for acquisition of the Mas property. The Council discussed scheduling a workshop to discuss the Village’s Strategic Plan. The Council will coordinate a date with the clerk for January, 2024. The clerk submitted a copy of the following proclamations issued by the mayor pursuant to Resolution 96-32: • Beth Am Basketball Day (December 9, 2023) The clerk submitted a copy of the minutes of the Zoning Board meeting of November 29, 2023. The clerk submitted the roster of appointees to the 2024 Zoning Board. The mayor opened the public hearing. The following addressed the Council: Daniel Enekes, 6463 Southwest 107 street, Pinecrest. Councilmember Hochkammer made a motion ratifying the manager’s appointment of Katherine Castellanos and the mayor’s appointment of Jordan D. Chisolm pursuant to Division 2.3(a) of the Land Development Code. The motion was seconded by Councilmember Abbott and adopted by a unanimous voice vote. The vote was as follows: Councilmembers Abbott, Fairman, Hochkammer, Vice Mayor del Prado, and Mayor Corradino voting Yes. VIII. 0451, FLORIDA STATUTES; AND PROVIDING FOR AN EFFECTIVE DATE. The mayor opened the public hearing. The following addressed the Council: Patricia Brid, 6280 Southwest 88 Street, Pinecrest. Vice Mayor del Prado made a motion to approve the resolution. The motion was seconded by Councilmember Hochkammer. Resolution 2023-95 was adopted by a 5 – 0 voice vote. The vote was as follows: Councilmembers Abbott, Fairman, Hochkammer, Vice Mayor del Prado, and Mayor Corradino voting Yes. IX. PLANNING: The following quasi-judicial proceedings were held by the Council, pursuant to Chapter 2 (Article VI) of the Code of Ordinances, at 7:00 p.m. time certain: All witnesses giving testimony were sworn-in by the clerk. HEARING #2023-1212-1. CARLOS ZAMORA (OWNER/APPLICANT) IS APPEALING THE DECISION OF THE PINECREST ZONING BOARD TO DENY A VARIANCE FROM THE SIDE AND REAR YARD SETBACK REQUIREMENTS OF DIVISION 4.2 (C) 5. G. OF THE LAND DEVELOPMENT REGULATIONS TO ALLOW EXISTING PICKLEBALL COURT TO REMAIN 8.74 FEET FROM THE SIDE (NORTH) PROPERTY LINE INSTEAD OF 19.20 FEET, AND 1.88 FEET FROM THE REAR (EAST) PROPERTY LINE INSTEAD OF 15 FEET; AND AN IMPERVIOUS COVERAGE VARIANCE TO ALLOW 54% IMPERVIOUS COVERAGE ON THE SUBJECT PROPERTY AND 46% GREEN SPACE INSTEAD OF 45% IMPERVIOUS COVERAGE AND 55% GREEN SPACE AS OTHERWISE REQUIRED; FOR THE PROPERTY LOCATED AT 11175 KILLIAN PARK ROAD. The following addressed the Council: Daniel Enekes, 6463 Southwest 107 Street; Juan Cardenal, 8101 Southwest 124 Street; and Patricia Brid, 6280 North Kendall Drive, Pinecrest. The applicant requested to withdraw the application. The Council unanimously denied the request. The motion was seconded by Councilmember Hochkammer and adopted by a roll call vote. The vote was as follows: Councilmembers del Abbott, Fairman, Hochkammer, Vice Mayor del Prado and Mayor Corradino voting Yes. The meeting was recessed at 8:52 p.m. and reconvened at 9:00 p.m. HEARING #2023-1212-2. VLADISLAVA FINSKAYA AND 5811 KENDALL PROPERTY, LLC (OWNERS); AND JAVIER VASQUEZ AND EDWARD BAKER (APPLICANTS) ARE APPEALING THE DECISION OF THE PINECREST ZONING BOARD TO DENY VARIANCES FROM THE MINIMUM LOT AREA REQUIREMENTS OF DIVISION 4.2 (E)5.A. OF THE LAND DEVELOPMENT REGULATIONS INCLUDING A LOT AREA OF 12,596 SQUARE FEET FOR PROSPECTIVE LOT 1 AND 14,271 SQUARE FEET FOR PROSPECTIVE LOT 2 INSTEAD OF 15,000 SQUARE FEET FOR EACH LOT AS OTHERWISE REQUIRED, TO ALLOW THE FUTURE PLATTING AND DIVISION OF THE 1PROPERTY INTO TWO (2) LOTS. PURSUANT TO AN APPROVED INTERLOCAL AGREEMENT, THE VILLAGE OF PINECREST HAS THE RESPONSIBILITY FOR REVIEW, PROCESSING, AND APPROVAL OF ALL ZONING MATTERS, FOR THE PROPERTY LOCATED AT 5811 NORTH KENDALL DRIVE (SW 88 ST). The Council disclosed ex parte communications. Edward Baker, representing the applicant, 1450 Brickell Avenue, Miami, addressed the Council. Planning Director Steve Olmsted gave an oral report, based on staff’s memorandum of December 1, 2023. The mayor opened the public hearing. The following addressed the Council: Juan Antorcha, 5795 Southwest 88 Street; Jose Hernandez, 5701 Southwest 88 Street; and Patricia Brid, 6280 Southwest 88 Street, Pinecrest. The meeting was recessed at 10:01 p.m. and reconvened at 10:05 p.m. Councilmember Fairman made a motion to approve the appeal of the Zoning Board decision, with the following conditions: 1. Lot 1 maintain a minimum of 7,000 square feet of green space 2. The motion failed by a 2 – 3 roll call vote. The vote was as follows: Councilmember Fairman and Mayor Corradino voting Yes; Councilmembers Abbott, Hochkammer, and Vice Mayor del Prado voting No. Councilmember Hochkammer made a motion to deny the appeal of the Zoning Board decision to deny lot area variances. The motion was seconded by Councilmember Abbott and adopted by a unanimous roll call vote. The vote was as follows: Councilmembers del Abbott, Hochkammer, Vice Mayor del Prado and Mayor Corradino voting Yes; Councilmember Fairman voting No. X.
