REGULAR MEETING MINUTES TUESDAY, FEBRUARY 8, 2022, 6:00 P.M. WWW.PINECREST-FL.GOV/LIVE A quorum of the Village Council was present at the Pinecrest Municipal Center in the Council Chamber. All others participated utilizing communications media technology (ZOOM). I. CALL TO ORDER/ROLL CALL OF MEMBERS: The meeting was called to order by the mayor at 6:00 p.m. Present were the following: Councilmember Shannon del Prado Councilmember Anna Hochkammer Councilmember Kraft Vice Mayor Katie Abbott Mayor Joseph M. CONSENT AGENDA: The following items were presented per the Council’s consent agenda policy pursuant to Ordinance 2014-6: • Minutes of January 11, 2022 (Regular Meeting) • Minutes of January 19, 2022 (Workshop) • Minutes of January 31, 2022 (Workshop) • A RESOLUTION OF THE VILLAGE OF PINECREST, FLORIDA, AUTHORIZING THE VILLAGE MANAGER TO EXECUTE AN AGREEMENT WITH THE FLORIDA DEPARTMENT OF TRANSPORTATION FOR LANDSCAPE MAINTENANCE OF PINECREST PARKWAY (US 1); PROVIDING FOR AN EFFECTIVE DATE. (2022-9) • A RESOLUTION OF THE VILLAGE OF PINECREST, FLORIDA, PERMITTING ALCOHOLIC BEVERAGES AT AN EVENT TO BE HELD ON JANUARY 28, 2023 AT PINECREST GARDENS PURSUANT TO RESOLUTION 2002-4; PROVIDING FOR AN EFFECTIVE DATE. (2022-10) • A RESOLUTION OF THE VILLAGE OF PINECREST, FLORIDA, APPROVING AN EMPLOYMENT AGREEMENT WITH VILLAGE CLERK PRISCILLA TORRES; PROVIDING FOR AN EFFECTIVE DATE. (2022-11) Councilmember Hochkammer made a motion adopting the consent agenda items. The motion was seconded by Councilmember del Prado and adopted by a unanimous voice vote. The vote was as follows: Councilmembers del Prado, Hochkammer, Kraft, Vice Mayor Abbott, and Mayor Corradino voting Yes. The following item was withdrawn from the consent agenda by Councilmember Hochkammer and considered separately by the Council: A RESOLUTION OF THE VILLAGE OF PINECREST, FLORIDA, ADOPTING THE 2022 PINECREST PARKS AND RECREATION MASTER PLAN; PROVIDING FOR AN EFFECTIVE DATE. Councilmember Hochkammer made a motion adopting the resolution. The motion was seconded by Vice Mayor Abbott. Resolution 2022-12 was adopted by a unanimous voice vote. The vote was as follows: Councilmembers del Prado, Hochkammer, Kraft, Vice Mayor Abbott, and Mayor Corradino voting Yes. The following item was withdrawn from the consent agenda by Councilmember Hochkammer and considered separately by the Council: A RESOLUTION OF THE VILLAGE OF PINECREST, FLORIDA, EXPRESSING OPPOSITION TO PROPOSED FLORIDA SENATE BILL 1024 AND HOUSE BILL 741, “NET METERING,” REVISING LEGISLATIVE FINDINGS RELATING TO REDESIGN OF NET METERING TO AVOID CROSS-SUBSIDIZATION OF ELECTRIC SERVICE COSTS BETWEEN CLASSES OF RATEPAYERS; PROVIDING FOR TRANSMITTAL; AND PROVIDING FOR AN EFFECTIVE DATE. February 8, 2022 Village Council Meeting Page 3 of 6 #Pinecresting FPL Representative Baldwyn English addressed the Council. The following addressed the Council: Lucas Hudson, 13390 Southwest 82 Avenue; Ruby Tenbroek, 9441 Southwest 70 Avenue; Daniel Enekes, 6463 Southwest 107 Street, Pinecrest. Councilmember Hochkammer made a motion adopting the resolution. The motion was seconded by Vice Mayor Abbott. Resolution 2022-13 was adopted by a unanimous voice vote. The vote was as follows: Councilmembers del Prado, Hochkammer, Kraft, Vice Mayor Abbott, and Mayor Corradino voting Yes. IV. AGENDA/ORDER OF BUSINESS: The Council heard the following items out-of-order without objection: Hearing #2022-0111-1. KENDALL IMPORTS, LLC (APPLICANT) IS REQUESTING THE VILLAGE COUNCIL’S FINAL DETERMINATION OF ARCHITECTURAL HARMONY AND APPROVAL OF THEIR REQUEST TO INTERNALLY ILLUMINATE THE EXISTING ENTRANCE PORTAL AT THE FRONT OF THE KENDALL TOYOTA AUTOMOBILE DEALERSHIP, LOCATED AT 10943 PINECREST PARKWAY, FLORIDA, WITHIN THE BU-1A GENERAL BUSINESS DEVELOPMENT, AND BU-2, SPECIAL BUSINESS DEVELOPMENT ZONING DISTRICTS. Councilmember del Prado made a motion to defer the hearing to March 8, 2022. The motion was seconded by Councilmember Hochkammer and adopted by a unanimous voice call vote. The vote was as follows: Councilmembers del Prado, Hochkammer, Kraft, Vice Mayor Abbott, and Mayor Corradino voting Yes. V. SPECIAL PRESENTATIONS: Lucas Hudson, Chair of the Village’s Youth Advisory Council (YAC), made a brief presentation regarding the activities of the group in the past year. Each of the YAC’s groups also made presentations. Village Manager Yocelyn Galiano administered the oath of office to Village Clerk Priscilla Torres. VI. ORDINANCES: The clerk read the following ordinance, on first reading, by title: AN ORDINANCE OF THE VILLAGE OF PINECREST, FLORIDA, APPROVING THE INTERLOCAL AGREEMENT BETWEEN THE VILLAGE OF PINECREST AND CITY OF SOUTH MIAMI REGARDING REAL PROPERTIES ALONG KENDALL DRIVE, February 8, 2022 Village Council Meeting Page 4 of 6 #Pinecresting LOCATED WITHIN THE MUNICIPAL BOUNDARIES OF BOTH THE VILLAGE OF PINECREST AND CITY OF SOUTH MIAMI; PROVIDING FOR AUTHORIZATION; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS; AND PROVIDING FOR AN EFFECTIVE DATE. Candice Balmori, representing the attorney, provided a brief explanation about the proposed ordinance. The mayor opened the public hearing. There were no speakers. Councilmember del Prado made a motion adopting the ordinance on first reading. The motion was seconded by Councilmember Hochkammer and adopted by a unanimous roll call vote. The vote was as follows: Councilmembers del Prado, Hochkammer, Kraft, Vice Mayor Abbott, and Mayor Corradino voting Yes. The clerk announced second reading of the ordinance for March 8, 2022. The clerk read the following ordinance, on second reading, by title: AN ORDINANCE OF THE VILLAGE OF PINECREST, FLORIDA, AMENDING ARTICLE IX, “SPECIAL EVENTS,” OF CHAPTER 16 AND CHAPTER 18, “PARKS AND RECREATION DEPARTMENT RULES AND REGULATIONS,” RELATING TO SPECIAL EVENT PERMITTING PROCEDURES; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS; PROVIDING FOR CODIFICATION; AND PROVIDING FOR AN EFFECTIVE DATE. The mayor opened the public hearing. There were no speakers. Vice Mayor Abbott made a motion adopting the ordinance on second reading. The motion was seconded by Councilmember Hochkammer. Ordinance 2022-02 was adopted by a unanimous roll call vote. The vote was as follows: Councilmembers del Prado, Hochkammer, Kraft, Vice Mayor Abbott, and Mayor Corradino voting Yes. The clerk read the following ordinance, on second reading, by title: AN ORDINANCE OF THE VILLAGE OF PINECREST, FLORIDA, AMENDING THE VILLAGE’S COMPREHENSIVE DEVELOPMENT MASTER PLAN TO INCLUDE A NEW PROPERTY RIGHTS ELEMENT CONSISTING OF NEW GOALS, OBJECTIVES, AND POLICIES; PROVIDING FOR AMENDMENT AND ADOPTION; February 8, 2022 Village Council Meeting Page 5 of 6 #Pinecresting PROVIDING FOR INCLUSION IN THE COMPREHENSIVE DEVELOPMENT MASTER PLAN; PROVIDING FOR TRANSMITTAL OF CERTIFIED COPIES OF THIS ORDINANCE TO THE FLORIDA DEPARTMENT OF ECONOMIC OPPORTUNITY AND ALL REQUIRED REVIEWING AGENCIES; AND PROVIDING FOR CONFLICT, SEVERABILITY, AND AN EFFECTIVE DATE. The mayor opened the public hearing. There were no speakers present. The gavel was passed to the vice mayor. Mayor Corradino made a motion adopting the ordinance on second reading. The motion was seconded by Councilmember Kraft. Ordinance 2022-05 was adopted by a unanimous roll call vote. The vote was as follows: Councilmembers del Prado, Hochkammer, Kraft, Vice Mayor Abbott, and Mayor Corradino voting Yes. The gavel was returned to the mayor. VII. REPORTS AND RECOMMENDATIONS: The mayor provided an update on the US1 Vision Plan. The manager discussed the process and next steps to hire the consultants, scope of services, and creation of the Pinecrest Parkway Vision Committee. The manager submitted the following communiqués to the Council: • February 2022 Follow-up Report • Monthly Departmental Reports • Freebee Update • Palmetto Senior Development Review Vice Mayor Abbott requested an update of the Palmetto Senior Development Review. The council unanimously authorized the manager to increase the budget by $140,000 for the design of the Coral Pine Park project. The council unanimously authorized the manager to resume in-person council meetings and allow optional use of masks during council meetings. VIII. RESOLUTIONS: The Council discussed the following resolution: A RESOLUTION OF THE VILLAGE OF PINECREST, FLORIDA, APPROVING AN INTERLOCAL AGREEMENT WITH MIAMI-DADE COUNTY GOVERNING THE February 8, 2022 Village Council Meeting Page 6 of 6 #Pinecresting PROVISION OF ON-DEMAND SERVICES IN THE VILLAGE; PROVIDING FOR AUTHORIZATION; PROVIDING FOR IMPLEMENTATION; PROVIDING FOR TRANSMITTAL; AND PROVIDING FOR AN EFFECTIVE DATE. Councilmember Hochkammer made a motion to approve the resolution. The motion was seconded by Vice Mayor Abbott. Resolution 2022-14 was adopted by a unanimous voice vote. The vote was as follows: Councilmembers del Prado, Hochkammer, Kraft, Vice Mayor Abbott, and Mayor Corradino voting Yes. IX. PLANNING: The following quasi-judicial proceeding was held by the Council, pursuant to Chapter 2 (Article VI) of the Code of Ordinances, at 7:00 p.m. time certain: This item was immediately heard after Item IV.
