RESOLUTION NO. 2023- A RESOLUTION OF THE VILLAGE OF PINECREST, FLORIDA, APPROVING, ADOPTING, AND CONFIRMING A PRELIMINARY ASSESSMENT ROLL PROVIDING FOR ANNUAL ASSESSMENTS AGAINST REAL PROPERTY LOCATED WITHIN THE BOUNDARIES OF THE PINECREST BY THE SEA SECURITY GUARD SPECIAL TAXING DISTRICT (ALSO KNOWN AS THE GABLES BY THE SEA-PINECREST SECURITY GUARD SPECIAL TAXING DISTRICT) GENERALLY BOUNDED ON THE NORTH BY LUGO AVENUE, ON THE EAST BY SW 57 AVENUE, ON THE SOUTH BY SW 136 STREET, AND ON THE WEST BY OLD CUTLER ROAD; PROVIDING THAT ASSESSMENTS MADE SHALL CONSTITUTE A SPECIAL ASSESSMENT LIEN ON REAL PROPERTY; PROVIDING FOR THE COLLECTION OF SUCH ASSESSMENTS; PROVIDING FOR RECORDING; PROVIDING FOR IMPLEMENTATION; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, pursuant to Chapter 18 of the Miami-Dade County (“County”) Code of Ordinances, on October 6, 2022, the County Board of County Commissioners adopted Ordinance No. 22-122 (the “Ordinance”), reconstituting the existing Gables by the Sea Security Guard Special Taxing District into two separate special taxing districts: the Pinecrest by the Sea Security Guard Special Taxing District (also known as the Gables by the Sea-Pinecrest Security Guard Special Taxing District) (the “District”) and the Gables by the Sea-Coral Gables Security Guard Special Taxing District, which districts encompass only those properties located entirely within the Village of Pinecrest (the “Village”) and the City of Coral Gables, respectively; and WHEREAS, on January 10, 2023, the Village Council adopted Resolution No. 2023-5, accepting the transfer of the District to the Village in accordance with County Resolution No. R-896- 22 and approving an interlocal agreement relating to the same (the “Interlocal Agreement”); and WHEREAS, the Ordinance provided that the improvements and/or services provided by the District are a special benefit to all properties in the District and provided that the entire cost of the District’s improvements and/or services are to be specially assessed in an amount not in excess of such special benefit; and WHEREAS, subject to the requirements of Chapter 18 of the County Code of Ordinances, the Village is authorized to establish special assessment rates and collect special assessments for the District pursuant to Section 7 of the Interlocal Agreement and the Ordinance; and WHEREAS, in accordance with the provisions of Chapter 18 of the County Code of Ordinances, the Village Manager has caused a preliminary assessment roll to be prepared and filed with the Village Clerk for the provision of security guard services in the District; and WHEREAS, in accordance with the provisions of Section 18-14 of the County Code, notice of the public hearing on the preliminary assessment roll was provided; and WHEREAS, the Village Council has held a public hearing on this date upon the preliminary assessment roll submitted by the Village Manager and all interested persons were afforded an opportunity to present their objections, if any, with respect to such assessment roll; and WHEREAS, after due consideration, the Village Council found and determined that the assessments shown on the preliminary assessment roll were generally in direct proportion to the special benefits accruing to the respective parcels of real property appearing on said assessment roll; and WHEREAS, each property owner within the District was notified that the special assessments, when finally approved pursuant to Chapter 18 of the County Code, may be placed on their real property tax bills, and that, if the special assessments are not paid when due, the properties on which the special assessments are levied will be subject to the same collection procedures as for ad valorem taxes, including possible loss of title; and WHEREAS, the Village Council desires to adopt and confirm the preliminary assessment roll providing for special assessments against real property within the District for the purpose of providing security guard services; and WHEREAS, the Village Council finds that this Resolution is in the best interest and welfare of the citizens of the Village.

BE IT RESOLVED BY THE VILLAGE COUNCIL OF PINECREST, FLORIDA, AS FOLLOWS: Section 1. Recitals. That each of the above-stated recitals are hereby adopted, confirmed, and incorporated herein. Section 2. Preliminary Assessment Roll. The preliminary assessment roll for the District, attached hereto as Exhibit “A”, is hereby approved, adopted, and confirmed pursuant to Section 18-14(6) of the County Code of Ordinances. Section 3. Special Assessment Lien. All special assessments made upon said assessment roll shall constitute a special assessment lien upon the real property so assessed from the date of the confirmation of such assessments, in accordance with the provisions of Section 18- 14(8) of the County Code of Ordinances. Section 4. Collections. All special assessments are payable in accordance with Section 18-14(7) of the County Code of Ordinances. It is hereby declared that the special assessments imposed herein shall be collected by the Village by mailing invoices to each Tax Parcel/Folio for the Fiscal Year beginning October 1, 2023. Any delinquent or unpaid invoices shall be added to next year’s assessment roll, which will be collected and enforced using the uniform method for the levy, collection, and enforcement of non-ad valorem assessments provided by Chapter 197, Florida Statutes, known as the Uniform Method of Collection. Section 5. Recording. Within 30 days from the Effective Date of this Resolution, the Village Clerk shall deliver to the Village Finance Director a copy of the assessment roll, and cause a duly certified copy of this Resolution, together with the assessment roll, to be filed and recorded in the Office of the Clerk of the Circuit Court of Miami-Dade County, Florida. Section 6. Implementation. That the Village Manager is hereby authorized to take all actions necessary to implement the purposes of this Resolution. Section 7. Effective Date. This Resolution shall take effect immediately upon adoption. PASSED AND ADOPTED this 12th day of September, 2023. Joseph M.
