WHEREAS, the Village Council adopted Ordinance 97-19 (amended by Ordinances 98-14 and 2012-11) which established speed limits in the Village; and

ORDINANCE NO. 2026- AN ORDINANCE OF THE VILLAGE OF PINECREST, FLORIDA, AMENDING SECTION 36-1(C) OF THE CODE OF ORDINANCES RELATING TO SPEED LIMITS IN THE VILLAGE OF PINECREST; PROVIDING FOR SEVERABILITY, INCLUSION IN THE CODE AND AN EFFECTIVE DATE. WHEREAS, the Village Council adopted Ordinance 97-19 (amended by Ordinances 98-14 and 2012-11) which established speed limits in the Village; and WHEREAS, pursuant to

Section 316.

183, Florida Statutes, the maximum speed limits for all vehicles must be 30 miles per hour in business or residence districts; and WHEREAS, pursuant to

Section 316.

189, Florida Statutes, the maximum speed limit within any municipality is 30 miles per hour; and WHEREAS, the Village Council desires to amend Section 36-1(c) of the Code of Ordinances to reduce posted speed limits from 35 miles per hour to 30 miles per hour where applicable and consistent with

Section 316.

189, Florida Statutes;

NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF PINECREST, FLORIDA, AS FOLLOWS: Section 1. That Section 36-1(c) of the Village of Pinecrest Code of Ordinances is hereby amended to read as follows1: Speed limits. *** 1 Underlined text has been added. Strike-through text has been deleted. -2- (3) There is hereby established municipal speed limits within the Village of Pinecrest as follows: a. 15 MPH roads: 1. A speed limit of 15 miles per hour in any alley. 2. A speed limit of 15 miles per hour within any school zone. b. 20 MPH roads: 1. A speed limit of 20 miles per hour on all residential roads in the following prescribed areas: a. Pinecrest-by-the-Sea. The area bounded by Old Cutler Road on the west, but not including Old Cutler Road, Southwest 136 Street (Howard Drive) on the south, Southwest 57 Avenue (Red Road) on the east, and Southwest 128 Street (Lugo Avenue) on the north. b. Elysium. The area bounded by Southwest 58 Court on the west, Southwest 113 Street on the south, Southwest 57 Avenue (Red Road) on the east, and Southwest 111 Terrace on the north. c. 30 MPH roads: 1. A speed limit of 30 miles per hour on all residential roads not otherwise prescribed herein. d. 35 30 MPH roads: 1. A speed limit of 35 30 miles per hour on all business roads not otherwise prescribed herein. -3- 2. A speed limit of 35 30 miles per hour on Southwest 72 Avenue from US1 (South Dixie Highway/Pinecrest Parkway) to Southwest 136 Street (Howard Drive). 3. A speed limit of 35 30 miles per hour on Southwest 77 Avenue (Palmetto Road) between Southwest 104 Street (Lombardy Street) and Southwest 136 Street (Howard Drive). 4. A speed limit of 35 30 miles per hour on Southwest 67 Avenue (Ludlam Road) between Southwest 88 Street (Kendall Drive) and Southwest 136 Street (Howard Drive). 5. A speed limit of 35 30 miles per hour on Southwest 104 Street (Lombardy Street) between Southwest 57 Avenue (Red Road) and US1 (South Dixie Highway/Pinecrest Parkway). 6. A speed limit of 35 30 miles per hour on Southwest 120 Street (Montgomery Drive) between Southwest 57 Avenue (Red Road) and US1 (South Dixie Highway/Pinecrest Parkway). 7. A speed limit of 35 30 miles per hour on Southwest 124 Street /Chapman Field Drive between US 1 (South Dixie Highway/Pinecrest Parkway) and Old Cutler Road (Ingraham Highway). 8. A speed limit of 35 30 miles per hour on Killian Drive (Southwest 112 Street/Southwest 111 Street) between US 1 (South Dixie Highway/Pinecrest Parkway) and Southwest 57 Avenue (Red Road). Section 3. Severability. The provisions of this Ordinance are declared to be severable and if any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, clauses, and phrases of this Ordinance but they shall -4- remain in effect, it being the legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. Section 4. Inclusion in the Code. It is the intention of the Village Council, and it is hereby ordained that the provisions of this Ordinance shall become and be made a part of the Code of the Village of Pinecrest, Florida. Section 5. Effective Date. This Ordinance shall be effective upon adoption on second reading. PASSED on first reading this 10th day of February, 2026.
