REGULAR MEETING MINUTES TUESDAY, JANUARY 9, 6:00 P.M. PINECREST MUNICIPAL CENTER/COUNCIL CHAMBER 12645 PINECREST PARKWAY PINECREST, FLORIDA I. CALL TO ORDER/ROLL CALL OF MEMBERS: The meeting was called to order by the mayor at 6:00 p.m. Present were the following: Councilmember Katie Abbott Councilmember Shannon del Prado Councilmember Ken Fairman Vice Mayor Anna Hochkammer Mayor Joseph M. Corradino Village Manager Yocelyn Galiano Village Clerk Priscilla Torres Village Attorney Mitchell Bierman II. PLEDGE OF ALLEGIANCE: The mayor led the Pledge of Allegiance. III. CONSENT AGENDA: The following items were presented per the Council’s consent agenda policy pursuant to Ordinance 2014-6: • Minutes of December 12, 2023 (Regular Meeting) The mayor opened the public hearing. There were no speakers present. Vice Mayor del Prado made a motion adopting the consent agenda item. The motion was seconded by Councilmember Abbott and adopted by a unanimous voice vote. The vote was as follows: Councilmembers Abbott, del Prado, Fairman, Vice Mayor Hochkammer, and Mayor Corradino voting Yes. IV. AGENDA/ORDER OF BUSINESS: There were no changes to the agenda. SPECIAL PRESENTATIONS: Aayana Baid, of the Village’s Youth Advisory Council (YAC), made a presentation regarding the activities of the group in the past year. Each of the YAC’s members also made presentations. VI. ORDINANCES: The Council discussed the following ordinance on first reading: AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF PINECREST, FLORIDA, AMENDING THE VILLAGE CODE OF ORDINANCES, CHAPTER 30, LAND DEVELOPMENT REGULATIONS, ARTICLE 5, ADDITIONAL REGULATIONS; DIVISION 5.5, FENCES AND WALLS; PROVIDING FOR CODIFICATION; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. The planning director and police chief addressed the Council. The mayor opened the public hearing. Luiz Gandelman, 5950 Southwest 115 Street, Pinecrest, addressed the Council. The council directed staff to revise the ordinance and bring it back for first reading at a future meeting. The Council discussed the following ordinance on second reading: AN ORDINANCE OF THE VILLAGE OF PINECREST, FLORIDA, CREATING SECTION 36-4 OF THE VILLAGE CODE OF ORDINANCES TO AUTHORIZE THE PLACEMENT, INSTALLATION, AND OPERATION OF SPEED DETECTION SYSTEMS ON ROADWAYS MAINTAINED AS SCHOOL ZONES, ESTABLISH TRAFFIC ENFORCEMENT PROCEDURES WHEN SPEED DETECTION SYSTEMS ARE UTILIZED FOR SCHOOL ZONE SPEED LIMIT VIOLATIONS, AND CREATE HEARING PROCEDURES RELATING TO SUCH SCHOOL ZONE SPEED LIMIT VIOLATIONS; PROVIDING FOR IMPLEMENTATION; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS; PROVIDING FOR CODIFICATION; AND PROVIDING FOR AN EFFECTIVE DATE. The attorney addressed the Council. The mayor opened the public hearing. There were no speakers. January 9, 2024 Village Council Meeting Page 3 of 5 #Pinecresting Vice Mayor del Prado made a motion to approve the ordinance on Second Reading. The motion was seconded by Councilmember Abbott. Ordinance 2024-1 was adopted by a unanimous roll call vote. The vote was as follows: Councilmembers Abbott, del Prado, Fairman, Vice Mayor Hochkammer, and Mayor Corradino voting Yes. VII. REPORTS AND RECOMMENDATIONS: The manager submitted the following communiqués and reports to the Council: • January 2024 Follow-up Report • Monthly Departmental Reports • Freebee Update The manager provided an update on the purchase of the Mas property and the revised closing date after an extension was requested. The manager provided an update on Hidden Pines Park which includes research on the property's ownership in the county property records. A meeting with FPL to discuss the easement agreement and potential power line rerouting has also been set. The manager provided an update on the Christ the King (CTK) property which included no new information other than the pending appraisal reports. The attorney provided the Council with an update on V. Dean Warhaft, et al v. Village of Pinecrest (Case No. 2022-019253-CA-01), and had a discussion with the mayor and council regarding the historical designation on Old Cutler Road and Ludlam Road, which obstructs the ability to implement traffic safety measures. The council discussed the possible re-scheduling of the March and May regular meetings. Dates will be reviewed and discussed by the council during the strategic plan workshop. VIII. RESOLUTIONS: The Council discussed the following resolution: A RESOLUTION OF THE VILLAGE OF PINECREST, FLORIDA, DESIGNATING KATHLEEN LINTON AS THE CLERK TO THE LOCAL HEARING OFFICER FOR SCHOOL ZONE SPEEDING VIOLATIONS ENFORCED UTILIZING SPEED DETECTION SYSTEMS IN ACCORDANCE WITH
1896, FLORIDA STATUTES; AND PROVIDING FOR AN EFFECTIVE DATE. January 9, 2024 Village Council Meeting Page 4 of 5 #Pinecresting The mayor opened the public hearing. There were no speakers. Councilmember Abbott made a motion to approve the resolution. The motion was seconded by Vice Mayor del Prado. Resolution 2024-1 was adopted by a 5 – 0 Voice vote. The vote was as follows: Councilmembers Abbott, Fairman, Hochkammer, Vice Mayor del Prado, and Mayor Corradino voting Yes. IX. PLANNING: There were no planning matters considered by the Council. A. HEARING #2024-0109-1. PIPHTY THREE HOLDINGS LLC (OWNER) AND PINECREST PHYSICAL THERAPY, LLC (APPLICANT) ARE APPLYING FOR APPROVAL OF AN OFF-SITE PARKING AGREEMENT WITH ECHO EIGHT LLC AND DAMIANI PURSUANT TO THE REQUIREMENTS OF DIVISION 5.22 (B) 3. OF THE VILLAGE’S LAND DEVELOPMENT REGULATIONS TO ALLOW FOR THE ALLOCATION OF FIVE (5) EXCESS PARKING SPACES AT DAMIANI TO BE USED TO SATISFY THE VILLAGE’S MINIMUM PARKING REQUIREMENTS AT PINECREST PHYSICAL THERAPY, WITHIN THE BU-2, SPECIAL BUSINESS DEVELOPMENT ZONING DISTRICT, FOR THE PROPERTIES LOCATED AT 8935 PINECREST PARKWAY (PINECREST PHYSICAL THERAPY) AND 8865 PINECREST PARKWAY (DAMIANI). The Council disclosed ex parte communications. Ron Yacoub, the applicant, and John Adams, 1390 South Dixie Highway, Miami, addressed the Council. Planning Director Olmsted gave an oral report, based on his memorandum of January 2, 2024, recommending approval of the request, subject to conditions of approval. The mayor opened the public hearing. There were no speakers present. Councilmember Fairman made a motion to approve the variance with staff recommendations. The motion was seconded by Vice Mayor del Prado and approved on a 5 – 0 vote. The vote was as follows: Councilmembers Abbott, Fairman, Hochkammer, Vice Mayor del Prado and Mayor Corradino voting Yes. X. SCHEDULE OF FUTURE MEETINGS: The following schedule of future meetings was presented to the public: • VILLAGE COUNCIL WORKSHOP WEDNESDAY, FEBRUARY 7, 2024, 9:00 A.M.
