CONSENT AGENDA: The following items were presented per the Council’s consent agenda policy pursuant to Ordinance 2014-6: Minutes of April 11, 2023 (Regular Meeting) A RESOLUTION OF THE VILLAGE OF PINECREST, FLORIDA, AWARDING A BID TO WAYPOINT CONTRACTING FOR THE FLAGLER GROVE PARK EQUIPMENT YARD PROJECT; PROVIDING FOR AN EFFECTIVE DATE. (2023-37) A RESOLUTION OF THE VILLAGE OF PINECREST, FLORIDA, AUTHORIZING THE VILLAGE MANAGER TO ENTER INTO AN AGREEMENT WITH AVENU INSIGHTS & ANALYTICS, LLC FOR SHORT-TERM RENTAL MONITORING SOFTWARE; PROVIDING FOR AN EFFECTIVE DATE. (2023-38) May 9, 2023 Village Council Meeting Page 2 of 6 #Pinecresting A RESOLUTION OF THE VILLAGE OF PINECREST, FLORIDA, AUTHORIZING THE VILLAGE MANAGER TO ENTER INTO AN AGREEMENT WITH RJ HEISENBOTTLE ARCHITECTS FOR THE DESIGN OF THE PINECREST GARDENS TERRACE AND RAMP RENOVATIONS; PROVIDING FOR AN EFFECTIVE DATE. (2023-39) A RESOLUTION OF THE VILLAGE OF PINECREST, FLORIDA, AUTHORIZING THE VILLAGE MANAGER TO ENTER INTO AN AGREEMENT WITH MIAMI CULINARY KITCHEN LLC FOR OPERATION OF THE FARMERS MARKET AT PINECREST GARDENS; PROVIDING FOR AN EFFECTIVE DATE. (2023-40) A RESOLUTION OF THE VILLAGE OF PINECREST, FLORIDA, AUTHORIZING THE VILLAGE MANAGER TO EXECUTE AN AMENDMENT TO AN AGREEMENT WITH AECOM FOR THE CORAL PINE PARK DESIGN PLANS; PROVIDING FOR AN EFFECTIVE DATE. (2023-41) The mayor opened the public hearing. There were no speakers present. Vice Mayor Hochkammer made a motion adopting the consent agenda items. The motion was seconded by Councilmember del Prado and adopted by a unanimous voice vote. The vote was as follows: Councilmembers Abbott, del Prado, Fairman, Vice Mayor Hochkammer, and Mayor Corradino voting Yes. IV. AGENDA/ORDER OF BUSINESS: There were no changes to the agenda. V. SPECIAL PRESENTATIONS: The Council recognized the following Teachers of the Year and Rookie Teachers of the Year from Pinecrest’s public schools: Teacher of the Year o Yuria Sharp (Miami Palmetto Senior High) o Monique Acevedo (Howard Drive Elementary) o Michelle Garcia (Pinecrest Elementary) o Kinsey Simmons (Palmetto Elementary) o Kristie Ladines (Palmetto Middle) Rookie Teacher of the Year o Laken Darst (Miami Palmetto Senior High) o Karina Peñate (Pinecrest Elementary) o Yeilin Loo (Palmetto Middle) May 9, 2023 Village Council Meeting Page 3 of 6 #Pinecresting Pinecrest Parks and Recreation Director Robert Mattes made a presentation to the Council regarding the Gary Matzner Conceptual Design update. Vice Mayor Hochkammer made a motion to table the item temporarily. The motion was seconded by Councilmember del Prado and adopted by unanimous consent. The mayor opened the public hearing. The following addressed the Council: Bob Spielman, 9000 Southwest 65 Court; Phil Rinaldi, 8871 Southwest 68 Avenue; Karen Spiegelman, 6700 Southwest 88 Terrace; Karen Ross, 6791 Southwest 94 Street; Jose Mora, 8941 Southwest 65 Court; Ashley Hamilton, 8940 Southwest 65 Court; Ricardo Arcia, 6450 Southwest 88 Street; Patricia Brid, 6280 Southwest 88 Street; Humberto Silvestre, 8841 Southwest 68 Avenue; Harry Speizer, 10001 Southwest 70 Avenue; David Magidson, 6705 Southwest 88 Terrace; John Proctor, 6775 Southwest 89 Terrace, Pinecrest; and Miguel Diaz de la Portilla, 600 Brickell Ave, Miami. Councilmember Fairman made a motion to approve Concept A. The motion was seconded by Vice Mayor Hochkammer and adopted by a unanimous voice vote. The vote was as follows: Councilmembers Abbott, del Prado, Fairman, Vice Mayor Hochkammer, and Mayor Corradino voting Yes. The manager's recommendation to move the shelter as shown in Concept B was approved by the Council unanimously. VI. ORDINANCES: There were no ordinances to discuss. VII. REPORTS AND RECOMMENDATIONS: Councilmember Fairman addressed the Council and introduced Julio Casals, a representative of One Blood, who acknowledged and awarded certificates to first-time donors who took part in the Go for 44 Blood Drive. The item on the agenda for SW 67th Ave Shared Use Path was removed by the mayor. There was no discussion on the matter. The manager submitted the following communiqués and reports to the Council: April 2023 Follow-up Report Monthly Departmental Reports Freebee Update Employee Vaccination Update The manager gave an update on the 136 Street landscaping project. The manager presented a draft of the Land Acquisition Policy prepared as part of the Strategic Plan. The Council provided feedback in preparation of the final policy for formal adoption at a future meeting. Letter of Interest were submitted to both property owners. There has been no response from the property owners. The manager gave update on the Christ the King Snapper Creek property. By unanimous consent, the Council directed the manager to submit a Letter of Intent. The manager gave an update on the electronics recycling program and is considering holding the event twice a year due to the popularity of the event. The clerk submitted a copy of the following proclamations issued by the mayor pursuant to Resolution 96-32: Arbor Day (April 28, 2023) Gun Violence Awareness Day (June 2, 2023) The planning director addressed the Council and informed the nominations for the Architectural Review Board will be presented for approval during the next meeting. The attorney requested an Executive Session in the matter of Megladon Inc. vs. Village of Pinecrest, Case No: 21-CV-22819-RKA for June 16, 2023. The Council re-scheduled the July regular meeting to July 18, 2023. The Council scheduled a budget workshop for August 8, 2023, at 9:00 a.m. The attorney announced that the firm will receive the Florida Legal Award in the Innovators category for the work done by their team on the FEMA mediation. VIII. RESOLUTIONS: The Council discussed the following resolution: A RESOLUTION OF THE VILLAGE OF PINECREST, FLORIDA, SUPPLEMENTING THE ORDINANCE ENACTED ON APRIL 11, 2023, WHICH AUTHORIZED THE BORROWING OF MONEY; AUTHORIZING THE ISSUANCE OF ITS $5,852,377.38 CAPITAL IMPROVEMENT REVENUE NOTE, SERIES 2023A, FOR THE PURPOSE OF FINANCING THE CONSTRUCTION AND ACQUISITION OF CERTAIN CAPITAL PROJECTS, AS MORE FULLY DESCRIBED HEREIN; AUTHORIZING THE NEGOTIATED SALE OF SUCH NOTE TO TD BANK, N.A., PURSUANT TO THE TERMS AND CONDITIONS OF A LOAN AGREEMENT BY AND AMONG THE FLORIDA MUNICIPAL LOAN COUNCIL, THE VILLAGE OF May 9, 2023 Village Council Meeting Page 5 of 6 #Pinecresting PINECREST, FLORIDA, AND TD BANK, N.A.; APPROVING THE FORM OF AND AUTHORIZING THE EXECUTION AND DELIVERY OF THE LOAN AGREEMENT; MAKING CERTAIN OTHER COVENANTS AND AGREEMENTS IN CONNECTION WITH THE ISSUANCE OF SUCH NOTE; AND PROVIDING AN EFFECTIVE DATE. The mayor opened the public hearing. There were no speakers. Vice Mayor Hochkammer made a motion to approve the resolution. The motion was seconded by Councilmember Abbott. Resolution 2023-42 was adopted by a 5 – 0 Voice vote. The vote was as follows: Councilmembers Abbott, del Prado, Fairman, Vice Mayor Hochkammer, and Mayor Corradino voting Yes. The Council discussed the following resolution: A RESOLUTION OF THE VILLAGE OF PINECREST, FLORIDA, MODIFYING EXISTING RESTRICTIONS RELATING TO NIGHT-TIME PARTIES WITH ALCOHOL AT PINECREST GARDENS TO EXCLUDE FROM THE RESTRICTIONS PARTIES HELD AT INDOOR FACILITIES AT THE VENUE; PROVIDING FOR AN EFFECTIVE DATE. The mayor opened the public hearing. Angel Gallinal, 5820 Southwest 111 Terrace; Patricia Brid, 6280 Southwest 88 Street; and Bob Hingston; 8020 Southwest 135 Street, Pinecrest, addressed the Council. Vice Mayor Hochkammer made a motion to defer the matter to the meeting of June 13, 2023. The motion was seconded by Councilmember Fairman and adopted by a 5 – 0 voice vote. The vote was as follows: Councilmembers Abbott, del Prado, Fairman, Vice Mayor Hochkammer, and Mayor Corradino voting Yes. IX. PLANNING: There were no planning matters considered by the Council. X. Corradino Village Manager Yocelyn Galiano Village Clerk Priscilla Torres Village Attorney Mitchell Bierman The Council discussed the following litigation matter in an Executive Session pursuant to F.S. 286.011: MEGLADON INC. VS. VILLAGE OF PINECREST, CASE NO. 21-CV-22819-RKA The Executive Session was requested by the attorney at a public meeting and was duly noticed by the clerk. The mayor announced that the purpose of the Executive Session was to discuss litigation strategy and that the following individuals would be present at the session: • Members of the Village Council • Village Manager Galiano Gomez • Village Attorneys Mitchell Bierman, Chad Friedman, Alicia Gonzalez, and Eric Stettin • Court Reporter May 16, 2023 Village Council Special Meeting Page 2 of 2 #Pinecresting The public meeting was recessed at 12:05 p.m. and the aforementioned individuals retreated to the Village Manager’s Conference Room for the Executive Session. Corradino Village Manager Yocelyn Galiano Village Clerk Priscilla Torres Village Attorney Mitchell Bierman There mayor led the Pledge of Allegiance. The Council also requested the manager to: • Develop a resolution asking the county to enforce feasibility • Enforce the connection of those properties that already have sanitary sewer • availability and they have not already done so • Lobby for a countywide general obligation bond • Conduct a comprehensive sanitary sewer study It was consensus of the Council to sponsor the Miami-Dade County League of Cities (MDCLC) 69th Annual Gala in the amount of $1,500 for a full-page color ad.
