Execute landscape maintenance agreement with Florida Department of Transportation

RESOLUTION NO. 2024- A RESOLUTION OF THE VILLAGE OF PINECREST, FLORIDA, AUTHORIZING THE VILLAGE MANAGER TO EXECUTE AN AGREEMENT WITH THE FLORIDA DEPARTMENT OF TRANSPORTATION FOR LANDSCAPE MAINTENANCE OF PINECREST PARKWAY (US 1); PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Village Council wishes to authorize the Village Manager to enter into a Turf and Landscape Maintenance Agreement, for the landscape maintenance of Pinecrest Parkway (US 1), between the Florida Department of Transportation and the Village;

NOW, THEREFORE,

BE IT RESOLVED BY THE VILLAGE COUNCIL OF PINECREST, FLORIDA, AS FOLLOWS: Section 1. That the Village Manager is hereby authorized to execute the attached Contract Renewal (No. ASV95) with the Florida Department of Transportation for landscape maintenance of Pinecrest Parkway (US 1). WITNESSETH: WHEREAS, the Department and the Contractor heretofore on this 21 day of March , 2023 (This date to be entered by DOT only) entered into an Agreement whereby the Department retained the Contractor to perform maintenance of all turf and landscape areas within the right-of-way on the State Roads described in "Exhibit A" of the original contract; and WHEREAS, said Agreement has a renewal option which provides for a renewal if mutually agreed to by both parties and subject to the same terms and conditions of the original Agreement;

NOW, THEREFORE, this Agreement witnesseth that for and in consideration of the mutual benefits to flow each to the other, the parties agree to a renewal of said original Agreement for a period beginning the 20 day of July, 2024 and ending the 19 day of July, 2025 at a cost of $7,876.00. All terms and conditions of said original Agreement shall remain in force and effect for this renewal. FDOT has requested a contract renewal for one year beginning July 20, 2024. This renewal reimburses the Village $7,876.00, which covers the cost for the Village’s landscape contractor to provide the service. I hereby respectfully recommend that the Village Council adopt the attached resolution which authorizes the Village Manager to execute the agreement with FDOT.
