RESOLUTION NO. 2023- A RESOLUTION OF THE VILLAGE OF PINECREST, FLORIDA, DESIGNATING KATHLEEN LINTON AS THE CLERK TO THE LOCAL HEARING OFFICER FOR SCHOOL ZONE SPEEDING VIOLATIONS ENFORCED UTILIZING SPEED DETECTION SYSTEMS IN ACCORDANCE WITH
1896, FLORIDA STATUTES; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on December 12, 2023, the Village Council of the Village of Pinecrest (“Village”) adopted an Ordinance on First Reading authorizing the placement, installation, and operation of speed detection systems on roadways maintained as school zones, establishing traffic enforcement procedures when speed detection systems are utilized for speed zone speed limit violations, and creating hearing procedures relating to such school zone speed limit violations (the “Ordinance”); and WHEREAS,
1896, Florida Statutes, provides that municipalities seeking to enforce school zone speed limit violations utilizing speed detection systems must designate by resolution existing staff to serve as the clerk to the local hearing officer for such violations; and WHEREAS, contingent upon the adoption of the Ordinance on Second Reading, the Village Council desires to designate Kathleen Linton as the clerk to the local hearing officer for violations of school zone speed limits enforced utilizing speed detection systems; and
NOW, THEREFORE,
BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF PINECREST, FLORIDA, AS FOLLOWS: Section 1. Recitals. That each of the above-stated recitals are hereby adopted, confirmed, and incorporated herein. Section 2. Designation. Contingent upon the adoption of the Ordinance on Second Reading, the Village Council hereby designates Kathleen Linton as the clerk to the local hearing officer for violations of school zone speed limits enforced utilizing speed detection systems. Section 3. Effective Date. This resolution shall take effect immediately upon adoption. PASSED AND ADOPTED this day of , 2024. Joseph M.
