(2022-28) Councilmember Hochkammer made a motion adopting the consent agenda items. The motion was seconded by Councilmember del Prado and adopted by a unanimous voice vote. AGENDA/ORDER OF BUSINESS: The Council heard the following items out-of-order without objection: Hearing #2022-0111-1. KENDALL IMPORTS, LLC (APPLICANT) IS REQUESTING THE VILLAGE COUNCIL’S FINAL DETERMINATION OF ARCHITECTURAL HARMONY AND APPROVAL OF THEIR REQUEST TO INTERNALLY ILLUMINATE THE EXISTING ENTRANCE PORTAL AT THE FRONT OF THE KENDALL TOYOTA AUTOMOBILE DEALERSHIP, LOCATED AT 10943 PINECREST PARKWAY, FLORIDA, WITHIN THE BU-1A GENERAL BUSINESS DEVELOPMENT, AND BU-2, SPECIAL BUSINESS DEVELOPMENT ZONING DISTRICTS. (DEFERRED FROM JANUARY 11, 2022, FEBRUARY 8, 2022, MARCH 8, 2022, AND APRIL 12, 2022) Councilmember Kraft made a motion to defer the hearing to May 10, 2022. The motion was seconded by Councilmember Hochkammer and adopted by a unanimous voice call vote. The Council discussed the following resolution: A RESOLUTION OF THE VILLAGE OF PINECREST, FLORIDA, ACCEPTING A DONATION FROM TIM ABBOTT FOR FUNDS FOR AN EMBOSSING MACHINE AND THE ACCOMPANYING SOFTWARE AT PINECREST GARDENS PURSUANT TO RESOLUTION 2016-36; PROVIDING FOR AN EFFECTIVE DATE. Pinecrest Gardens Director Alana Perez addressed the Council. The mayor opened the public hearing. There were no speakers. Councilmember del Prado made a motion to adopt the resolution. The motion was seconded by Councilmember Hochkammer. Resolution 2022-29 was adopted by a 4 – 0 – 1 voice call vote. The vote was as follows: Councilmembers del Prado, Hochkammer, Kraft, and Mayor Corradino voting Yes. Vice Mayor Abbott recused herself from the vote due to a conflict. V. The mayor opened the public hearing. There were no speakers. Councilmember Hochkammer made a motion adopting the ordinance on first reading. The motion was seconded by Vice Mayor Abbott and adopted by a unanimous roll call vote. The vote was as follows: Councilmembers del Prado, Hochkammer, Kraft, Vice Mayor Abbott, and Mayor Corradino voting Yes. The clerk announced second reading on May 10, 2022. The clerk read the following ordinance, on second reading, by title: AN ORDINANCE OF THE VILLAGE OF PINECREST, FLORIDA, APPROVING THE INTERLOCAL AGREEMENT BETWEEN THE VILLAGE OF PINECREST AND CITY OF SOUTH MIAMI REGARDING REAL PROPERTIES ALONG KENDALL DRIVE, LOCATED WITHIN THE MUNICIPAL BOUNDARIES OF BOTH THE VILLAGE OF PINECREST AND CITY OF SOUTH MIAMI; PROVIDING FOR AUTHORIZATION; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS; AND PROVIDING FOR AN EFFECTIVE DATE. The clerk read the following ordinance, on second reading, by title: AN ORDINANCE OF THE VILLAGE OF PINECREST, FLORIDA, AMENDING ARTICLE II, “NOISES; UNNECESSARY AND EXCESSIVE PROHIBITED,” OF CHAPTER 15 OF THE CODE OF ORDINANCES RELATING TO PERMITTED HOURS OF OPERATION FOR POWER TOOLS AND LANDSCAPING EQUIPMENT USED BY NON- COMMERCIAL ENTITIES AND COMMERCIAL ENTITIES; PROVIDING FOR CONFLICTS; PROVIDING FOR CODIFICATION; AND PROVIDING FOR AN EFFECTIVE DATE. The mayor opened the public hearing. The following addressed the Council: Christian Gruenwald, 6844 Southwest 96 Street, Pinecrest; Jeffrey Grannoff, 9601 Southwest 68 Avenue, Pinecrest. Councilmember Kraft made a motion adopting the ordinance on second reading as amended. The motion was seconded by Councilmember Hochkammer Ordinance 2022 - 8 was adopted by a unanimous roll call vote. REPORTS AND RECOMMENDATIONS: Vice Mayor Abbott requested authorization to donate $1,000 for the 2022 Relay for Life, consisting of the Village’s team and YAC. The Council unanimously authorized the donation. The mayor provided a Rapid Transit Zone (RTZ) update. Vice Mayor Abbott proposed that a proclamation be presented at the next Council meeting in honor of Supreme Court Judge Ketanji Brown Jackson. The request was unanimously approved by the Council. The manager submitted the following communiques and reports to the Council: • April 2022 Follow-up Report • Monthly Departmental Reports • Freebee Report • Electric Car charging update The manager was directed by Councilmember Hochkammer to provide monthly employee vaccination statistics. The manager submitted a request from the property owner of 11201 Southwest 69 Avenue for the mitigation of fines in the amount $109,309.50, for Code Enforcement fines. Alexander Borell, Esq., 7975 Northwest 154 Street, Miami Lakes, representing the owner, and John Keeler, the owner, addressed the Council. Councilmember del Prado made a motion authorizing a reduction of the fine to total $10,000. The motion was seconded by Councilmember Hochkammer. The Council unanimously authorized the reduction. The following addressed the Council: Jeffrey Grannoff, 9601 Southwest 68 Avenue, Pinecrest, and Riva Steinman, 6420 Southwest 135 Drive, Pinecrest. VIII. RESOLUTIONS: The Council discussed the following resolution: A RESOLUTION OF THE VILLAGE OF PINECREST, FLORIDA, ESTABLISHING THE PINECREST PARKWAY CITIZEN’S COMMITTEE; PROVIDING FOR MISSION; PROVIDING FOR AN EFFECTIVE DATE. The mayor opened the public hearing. The following addressed the Council: Riva Steinman, 6420 Southwest 135 Drive; and Laura McNaughton, 13401 Southwest 82 Avenue, Pinecrest. Vice Mayor Abbott made a motion to adopt the resolution. The motion was seconded by Councilmember Hochkammer. Resolution 2022-30 was adopted by a unanimous voice call vote. PLANNING: The following quasi-judicial proceeding was held by the Council, pursuant to Chapter 2 (Article VI) of the Code of Ordinances, at 7:00 p.m. time certain: All witnesses giving testimony were sworn-in by the clerk. Hearing Number #2022-0412-1. Francisco J. Mehech (owner and applicant) is appealing the decision of the Pinecrest Zoning Board to deny a variance from the side yard setback requirements of Division 4.2(C)5.G of the Land Development Regulations to allow a tennis court to be constructed 10 feet and 10 inches from the North and South side property lines instead of 20 feet as otherwise required, for the property located at prospective 9101 SW 64 Court (address to be assigned). Councilmembers disclosed ex parte communications. Jerry Proctor, 1450 Brickell Avenue, Miami, representing the applicant, addressed the Council. Bruce Stone, 6475 Southwest 92 Street; Trevor Taylor, 6455 Southwest 102 Street, Pinecrest, also addressed the Council. Francisco Mehech, the owner, also addressed the Council. Planning Director Steve Olmsted gave an oral report, based on staff’s memorandum of April 5, 2022, recommending denial of the request. The mayor opened the public hearing. The following addressed the Council: Carlos Flores, 9720 Southwest 72 Avenue; Ken Fairman, 10901 Southwest 60 Avenue; Jeffrey Grannoff, 9601 Southwest 68 Avenue, Pinecrest; Frank Rubino, 6698 Southwest 92 Street, Tucker Gibbs, representing Alexis & Enrique Hernandez, 9045 Southwest 64 Court; Alexis Hernandez, 9045 Southwest 64 Court; and Candise Shanbron, 8840 Southwest 64 Court. Councilmember Kraft made a motion to approve the request. The mayor passed the gavel to the vice mayor. The motion was seconded by Mayor Corradino and failed by a 2 – 3 roll call vote. The vote was as follows: Councilmember Kraft, and Mayor Corradino voting Yes; Councilmembers del Prado, Hochkammer, and Vice Mayor Abbott voting No. The vice mayor returned the gavel to the mayor. All others participated utilizing communications media technology (ZOOM). The special meeting was called to order by the vice mayor at 11:10 a.m. Present were the following: Councilmember Shannon del Prado Councilmember Anna Hochkammer Councilmember Doug Kraft Vice Mayor Katie Abbott Mayor Joseph M. Corradino Village Manager Yocelyn Galiano Village Clerk Priscilla Torres Village Attorney Mitchell Bierman The vice mayor led the Pledge of Allegiance.
