REGULAR MEETING MINUTES TUESDAY, OCTOBER 10, 2023, 6:00 P.M. PINECREST MUNICIPAL CENTER/COUNCIL CHAMBER 12645 PINECREST PARKWAY PINECREST, FLORIDA I. CALL TO ORDER/ROLL CALL OF MEMBERS: The meeting was called to order by the mayor at 6:00 p.m. Present were the following: Councilmember Katie Abbott (virtual) Councilmember Shannon del Prado Councilmember Ken Fairman Vice Mayor Anna Hochkammer Mayor Joseph M. Corradino Village Manager Yocelyn Galiano Village Clerk Priscilla Torres Village Attorney Mitchell Bierman II. PLEDGE OF ALLEGIANCE: The mayor led the Pledge of Allegiance. Councilmember del Prado made a motion to allow Councilmember Abbott to participate virtually. The motion was seconded by Vice Mayor Hochkammer and adopted by a unanimous voice vote. The vote was as follows: Councilmembers Abbott, del Prado, Fairman, Vice Mayor Hochkammer, and Mayor Corradino voting Yes. III. CONSENT AGENDA: The following items were presented per the Council’s consent agenda policy pursuant to Ordinance 2014-6: • Minutes of September 12, 2023 (Regular Meeting) • Minutes of September 19, 2023 (Special Meeting) October 10, 2023 Village Council Meeting Page 2 of 6 #Pinecresting • A RESOLUTION OF THE VILLAGE OF PINECREST, FLORIDA, AWARDING A BID TO J. PALMER GROUP FOR THE PINECREST GARDENS CYPRESS HALL DECK PROJECT; PROVIDING FOR AN EFFECTIVE DATE. (2023-71) • A RESOLUTION OF THE VILLAGE OF PINECREST, FLORIDA, AUTHORIZING THE VILLAGE MANAGER TO ENTER INTO AN AGREEMENT WITH KEITH FOR THE GARY MATZNER PARK DESIGN PROJECT; PROVIDING FOR AN EFFECTIVE DATE. (2023-72) • A RESOLUTION OF THE VILLAGE OF PINECREST, FLORIDA, AUTHORIZING THE VILLAGE MANAGER TO EXECUTE A COMBINED VOLUNTARY COOPERATION AND OPERATIONAL ASSISTANCE MUTUAL AID AGREEMENT BETWEEN THE CITY OF SWEETWATER, FLORIDA, AND THE VILLAGE OF PINECREST, FLORIDA; PROVIDING FOR AN EFFECTIVE DATE. (2023-73) • A RESOLUTION OF THE VILLAGE OF PINECREST, FLORIDA, AUTHORIZING THE VILLAGE MANAGER TO ENTER INTO A CONTRACT WITH COBB, FENDLEY AND ASSOCIATES, INC., FOR PROFESSIONAL SERVICES; PROVIDING FOR AN EFFECTIVE DATE. (2023-74) • A RESOLUTION OF THE VILLAGE OF PINECREST, FLORIDA, AUTHORIZING THE VILLAGE MANAGER TO ENTER INTO AN AGREEMENT WITH MIAMI CULINARY KITCHEN, LLC FOR MANAGEMENT OF PINECREST GARDENS FARMERS MARKET; PROVIDING FOR AN EFFECTIVE DATE. (2023-75) The mayor opened the public hearing. There were no speakers present. Councilmember del Prado made a motion adopting the consent agenda items. The motion was seconded by Vice Mayor Hochkammer and adopted by a unanimous voice vote. The vote was as follows: Councilmembers Abbott, del Prado, Fairman, Vice Mayor Hochkammer, and Mayor Corradino voting Yes. IV. AGENDA/ORDER OF BUSINESS: There were no changes to the agenda. V. SPECIAL PRESENTATIONS: Resident Jose Hernandez made a presentation to the Council regarding neighbor concerns. VI. ORDINANCES: The Council discussed the following ordinance on second reading: AN ORDINANCE OF THE VILLAGE OF PINECREST, FLORIDA, AUTHORIZING THE BORROWING OF MONEY AND THE INCURRENCE OF DEBT IN AN October 10, 2023 Village Council Meeting Page 3 of 6 #Pinecresting AMOUNT NOT TO EXCEED $18,000,000 FOR THE PURPOSE OF FINANCING THE CONSTRUCTION, ACQUISITION, RENOVATION, AND EQUIPPING OF CERTAIN CAPITAL PROJECTS; ESTABLISHING ITS INTENT TO REIMBURSE CERTAIN CAPITAL EXPENDITURES INCURRED IN CONNECTION WITH SUCH CAPITAL PROJECTS WITH THE PROCEEDS OF A FUTURE TAX-EXEMPT FINANCING FROM THE FLORIDA MUNICIPAL LOAN COUNCIL OR OTHER OBLIGATIONS; AND PROVIDING AN EFFECTIVE DATE. The manager addressed the Council. The mayor opened the public hearing. Jose Hernandez, 5701 Southwest 88 Street, Pinecrest, addressed the Council. Vice Mayor Hochkammer made a motion to approve the ordinance on Second Reading. The motion was seconded by Councilmember del Prado. Ordinance 2023-12 was adopted by a unanimous roll call vote. The vote was as follows: Councilmembers Abbott, del Prado, Fairman, Vice Mayor Hochkammer, and Mayor Corradino voting Yes. VII. REPORTS AND RECOMMENDATIONS: Councilmember Abbott postponed the Item VII.A.1 (Puzzle Library) to a future meeting. The manager submitted the following communiqués and reports to the Council: • September 2023 Follow-up Report • Monthly Departmental Reports • Freebee Update • Vaccination Incentive Program • Gulliver Prep Annual Enrollment Certification The manager provided an update regarding the Village’s acquisition of the “Mas” property, including an option to purchase agreement and financing options. The clerk submitted a copy of the following proclamations issued by the mayor pursuant to Resolution 96-32: • U.S. Constitution Week (September 17-23, 2023) • Hindu Heritage Month (October-November, 2023) The clerk submitted a memo dated October 3, 2023, regarding a scripter’s error on the minutes of the Council Workshop Meeting on August 8, 2023. October 10, 2023 Village Council Meeting Page 4 of 6 #Pinecresting The clerk submitted the Office of the Village Clerk Annual Report for the fiscal year 2022-2023. The meeting was recessed at 6:40 p.m., and reconvened at 7:00 p.m. VIII. RESOLUTIONS: The Council discussed the following resolution: A RESOLUTION OF THE VILLAGE OF PINECREST, FLORIDA SUPPLEMENTING THE ORDINANCE ENACTED ON OCTOBER 10, 2023; AUTHORIZING A LOAN IN AN AMOUNT NOT TO EXCEED $18,000,000 FROM THE FLORIDA MUNICIPAL LOAN COUNCIL TO ACQUIRE, CONSTRUCT, RENOVATE, AND/OR EQUIP CERTAIN CAPITAL PROJECTS, AS DESCRIBED HEREIN; APPROVING THE FORM OF AND THE EXECUTION AND DELIVERY OF A LOAN AGREEMENT WITH THE FLORIDA MUNICIPAL LOAN COUNCIL; APPROVING THE FORM OF AND THE EXECUTION AND DELIVERY OF A BOND PURCHASE CONTRACT; APPROVING THE FORM OF AND THE EXECUTION AND DELIVERY OF A CONTINUING DISCLOSURE AGREEMENT; AUTHORIZING THE DISTRIBUTION OF THE PRELIMINARY OFFICIAL STATEMENT AND THE OFFICIAL STATEMENT IN CONNECTION WITH THE FLORIDA MUNICIPAL LOAN COUNCIL REVENUE BONDS, SERIES 2023 (VILLAGE OF PINECREST SERIES); PROVIDING CERTAIN OTHER MATTERS IN CONNECTION WITH THE MAKING OF SUCH LOAN; AND PROVIDING AN EFFECTIVE DATE. Jason Breth, with the bond council, requested an amendment to the resolution as follows: WHEREAS, there is a substantial need for the continued preservation of the welfare and convenience of the Borrower and its citizens to finance (a) the acquisition of one or more parcels of property to be used for park and recreational purposes and the construction, renovation, and equipping of various improvements to such parcels of property, and (b) the acquisition, construction, renovation, and/or equipping of certain qualifying projects, including, but not limited to, (i) various park, athletic, and recreational facilities and improvements at certain Borrower parks and (ii) various transportation and stormwater facilities and improvements, all as more particularly described in the plans and specifications on file with the Borrower, as the same may be amended and supplemented from time to time by the Borrower (collectively, the "Projects"); and The mayor opened the public hearing. There were no speakers. Councilmember del Prado made a motion to approve the resolution as amended. The motion was seconded by Vice Mayor Hochkammer. Resolution 2023-76 was adopted by a 5 – 0 voice vote. The vote was as follows: Councilmembers Abbott, del Prado, Fairman, Vice Mayor Hochkammer, and Mayor Corradino voting Yes. PLANNING: The following quasi-judicial proceedings were held by the Council, pursuant to Chapter 2 (Article VI) of the Code of Ordinances, at 7:00 p.m. time certain: All witnesses giving testimony were sworn-in by the clerk. HEARING #2023-1010-1. Reverend Thomas Wenski Archbishop Archdiocese of Miami (Owner) and Carla Lopez (Applicant) are requesting approval of a Preliminary Subdivision Plat (“Morningstar Renewal Center”), within the PS, Public Service Zoning District. Proposed Tract “A” is 350,497 square feet (8.05 acres) in area. The purpose of the plat is to satisfy platting requirements and allow the future development of a 2,882 square foot meeting room and restrooms on the property, for property located at 7275 Southwest 124 Street. Carla Lopez, the applicant representing the owner, addressed the Council. Planning Director Stephen Olmsted gave an oral report, based on staff’s memorandum of October 3, 2023, recommending approval of the preliminary subdivision plat subject to conditions of approval. The mayor opened the public hearing. The were no speakers. Councilmember Fairman made a motion to approve the hearing with staff recommendations. The motion was seconded by Councilmember del Prado and adopted by a unanimous voice vote. The vote was as follows: Councilmembers Abbott, del Prado, Fairman, Vice Mayor Hochkammer, and Mayor Corradino voting Yes. IX.
